Chapter I General Principles

Article 1 In order to strengthen the management of the taxi market, maintain the order of the taxi market, improve the service quality and protect the legitimate rights and interests of passengers, operators and drivers, these Measures are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality.

Article 2 These Measures shall apply to the operation of passenger taxis and related activities within the administrative area of this Municipality.

Article 3 The municipal, district and county (city) traffic administrative departments shall be responsible for the management and supervision of passenger taxis within their respective administrative areas, and their subordinate passenger taxi management institutions shall perform specific management duties.

Development and reform, public security, industry and commerce, quality supervision, price and other departments shall, in accordance with their respective responsibilities, do a good job in the management and supervision of passenger taxis.

Article 4 A taxi trade association established according to law shall carry out activities in accordance with its articles of association.

City taxi industry association to develop industry professional norms, education and supervision association members abide by laws, regulations and industry professional norms; Strengthen industry self-discipline, improve industry service quality, accept social supervision, and promote and maintain fair market order; To provide relevant services to the members of the Association in accordance with the articles of association, reflect the opinions and suggestions of the members of the Association to the relevant administrative departments, and safeguard the legitimate rights and interests of the members of the Association; Assist industry authorities to handle related matters.

Fifth passenger taxi industry should follow the principles of overall planning, unified management, fair competition and steady development; Encourage the large-scale and intensive development of passenger taxis. Promote information management and use environmentally friendly and energy-saving vehicles.

Article 6 The municipal traffic administrative department shall, according to the needs of urban and rural development planning and economic and social development, formulate a development plan for the taxi industry, which shall be implemented after being approved by the Municipal People's Government.

Passenger taxis are subject to total control. The municipal traffic administrative department shall, according to the taxi industry development plan, market supply and demand situation and urban and rural traffic conditions, formulate the passenger taxi transport capacity index delivery plan, and report it to the Municipal People's government for approval before implementation.

The traffic administrative departments of counties (cities) and Shenbei New District and Sujiatun District may, according to the local market demand, put forward the development plan of taxi industry in this region, which shall be audited by the municipal traffic administrative department and implemented after being reported to the Municipal People's Government for approval.

Chapter II Management of Business Qualification

Article 7 The right to operate a new passenger taxi shall be determined by means of bidding in accordance with the principles of openness, transparency, fairness, order and fair competition, with service quality as the main bidding condition. The term of the right to operate a new taxi shall not exceed 6 years at the longest, and shall be recovered by the traffic administrative department after the expiration of the operation period. The specific implementation measures shall be formulated by the municipal traffic administrative department.

Eighth new taxi operating rights shall not be transferred or mortgaged. During the term of operation, if the operator cannot continue to operate for some reason, the traffic administrative department shall take back the right to operate.

Where the right to operate a taxi is transferred with compensation, it shall apply to the traffic administrative department for registration of change.

Article 9 An enterprise engaged in taxi business shall meet the following conditions:

(1) Having the right to operate a taxi with a ratio of more than 100 and corresponding vehicles;

(2) Having funds, business premises and parking lots suitable for its business scale;

(3) Having corresponding managers and drivers;

(4) Having a sound management system;

(five) the use of vehicle satellite positioning monitoring system and computer management system;

(6) Other prescribed conditions.

Article 10 Anyone who applies to engage in the operation of passenger taxi shall apply to the traffic administrative department. The traffic administrative department shall make a decision within 20 days from the date of acceptance. If the license is granted, a business license shall be issued; If the license is not granted, the reasons shall be informed in writing. The applicant can operate only after handling the industrial and commercial and tax registration according to law with the business license.

Where an operator changes the licensing items or suspends business, it shall be approved by the traffic administrative department in accordance with the regulations.

Eleventh operators who have obtained the right to operate a taxi shall, within 3 months, apply to the taxi management institution for issuing a road transport permit and a transportation permit with the purchase certificate, business license and other related procedures.

Twelfth taxi drivers should meet the following conditions:

(a) with the city's household registration or residence permit;

(2) Men under 60 years old and women under 55 years old are in good health;

(3) Holding a motor vehicle driver's license and having more than 2 years of driving experience;

(four) after the passenger service vocational training, and passed the examination, and obtained the qualification certificate;

(5) Other prescribed conditions.

Drivers who have been disqualified from passenger service shall not serve as taxi drivers within 5 years from the date of disqualification.

Thirteenth taxi drivers who have obtained professional qualifications shall go through the industrial and commercial registration with the taxi management agency, get a driver's license, drive designated vehicles, and participate in on-the-job training organized by the taxi management agency in accordance with regulations.

Fourteenth passenger taxi vehicles shall meet the following conditions:

(a) in line with national, industrial and local technical standards;

(2) Models, body colors and body decorations that meet the requirements of this Municipality;

(three) in accordance with the provisions of the installation of overhead lights, meters, empty rental signs, seat covers and other operating facilities;

(four) in accordance with the provisions of the installation of passenger taxi anti-counterfeiting logo;

(five) in accordance with the provisions of the taxi driver's license;

(6) Posting the vehicle charging standard at the specified position of the vehicle;

(seven) in accordance with the provisions of the installation of vehicle satellite positioning and related communication scheduling equipment;

(8) Other prescribed conditions.

Fifteenth passenger taxi vehicles operating period shall not exceed 6 years. Withdraw from the operating market, the operator shall dismantle the body decoration and operating facilities within 3 days, and return the relevant operating documents to the taxi management institution.

It is forbidden to set up operating facilities and related signs such as overhead lights and meters for passenger taxis on non-passenger taxis.

Sixteenth operators in the operating period to update the vehicle, should hold the original vehicle exit from the market, new vehicle purchase certificate, business warrants and other materials to the taxi management agencies to change the vehicle operation procedures.

Chapter III Commercial Service Management

Seventeenth passenger taxi self-employed to implement the entrusted management system.

Individual taxi operators can choose their own taxi business enterprises to implement entrusted management and report to the municipal taxi management agency for the record.

The specific measures for the entrusted management of individual taxi operators shall be formulated separately by the municipal traffic administrative department and promulgated and implemented after the approval of the Municipal People's government.

Eighteenth taxi operators shall comply with the following provisions:

(1) Abide by laws, regulations, rules and other relevant provisions;

(2) Establish and improve the operation management system, safety management system, service quality management system, training and education system and complaint handling system;

(three) by contracting, leasing the right to operate, commissioned by the way. , should be signed in accordance with the provisions of the contract, clear contract fees, rental fees and management fees and other related expenses standards and details;

(four) in accordance with the provisions of the maintenance and testing of vehicles, to ensure the technical condition of vehicles and facilities in good condition;

(5) A meter verified by a legal metrological verification institution in accordance with regulations;

(six) to strengthen the daily management of drivers, sign a service quality assurance agreement with drivers, clarify service standards, and provide drivers with relevant legal, safe operation and standardized service training on a regular basis;

(7) Reasonably arrange the shift change time of drivers, avoid the peak passenger flow in the morning and evening, and ensure the supply of transportation capacity;

(eight) shall not be handed over to unqualified taxi operators;

(nine) the content, location and area of advertisements shall meet the requirements of taxi industry management in addition to the provisions of advertising management.

Nineteenth taxi drivers should abide by the following provisions in their operations:

(a) to comply with the service standards of the industry, keep the vehicles clean and tidy, clean and tidy, standardize the dress and provide civilized service;

(2) Carrying the vehicle operation license, qualification certificate and driving license with the vehicle;

(3) Driving according to passengers' requirements or reasonable routes;

(four) shall not refuse to carry passengers or transfer passengers to others for transportation without justifiable reasons;

(five) it is forbidden to park, rent or carry passengers on the road where parking is prohibited;

(six) in accordance with the provisions of the use of overhead lights, meters, empty signs and other service facilities, in accordance with the wishes of passengers to use air conditioning, audio, etc. ;

(seven) when operating in airports, stations and other commercial stations, they should queue up in an orderly manner in the designated area, obey the dispatch, and must not leave the vehicle to attract passengers;

(eight) shall not use the car intercom facilities to spread and receive information unrelated to the operation;

(nine) in the passenger operation, there shall be no smoking, eating snacks and other acts;

(ten) in accordance with the provisions of the standard fees, and issue a fare bill;

(eleven) to transport passengers out of the city or to remote areas at night, it shall go through the safety registration formalities at the intercity police station set up by the public security organ or the nearest public security organ;

(twelve) abide by laws, regulations, rules and service management norms formulated by taxi management agencies.

Twentieth passengers have one of the following acts, the driver has the right to refuse service:

(a) consultation with the driver, not according to the provisions of the payment;

(2) requiring the driver to drive or stop in violation of regulations;

(3) Failing to inform the destination, leaving the city or going to a remote area, and failing to cooperate with the driver in handling the safety registration procedures;

(four) carrying illegal, defiled vehicles or carrying pets, which hinders the driver's driving safety;

(5) Mental patients are left unattended, and alcoholics lose their self-control ability and are unaccompanied;

(six) passengers smoking, dissuade invalid.

Twenty-first in any of the following circumstances, passengers can refuse to pay the fare:

(a) there is no meter or the meter is not used;

(2) Failing to complete the agreed service due to vehicle failure within the benchmark mileage;

(three) the driver fails to pay the fare bill in accordance with the provisions;

(4) Loading others without the permission of passengers;

(five) during the operation period, the operation service is terminated without justifiable reasons;

(six) the driver smokes, which is ineffective after being discouraged by passengers.

Twenty-second passenger taxi operating prices should strictly implement the standards approved by the price department. The expenses paid for transporting passengers through legal toll facilities and road sections shall be borne by passengers.

Twenty-third passenger taxi should operate in the approved area, and shall not engage in business activities such as accepting passengers outside the approved operating area.

Twenty-fourth traffic administrative departments shall, jointly with relevant departments, reasonably set up taxi business stations at airports, stations and other passenger distribution centers. Under the condition of not affecting traffic, certain areas can be set aside on both sides of urban roads and around them for taxi drivers to temporarily stop and rest for meals; Conditional, can establish a fixed taxi driver service area.

Chapter IV Supervision and Administration

Twenty-fifth taxi management agencies should regularly assess the service quality and reputation of operators and drivers, and verify the operation of vehicles.

The evaluation result of service quality reputation of operators is an important basis for operators to continue to operate, update vehicles and increase transport capacity.

The credit evaluation of driver's service quality shall implement the cumulative scoring system, and the drivers whose cumulative scores reach the prescribed scores shall provide vocational training in accordance with the regulations; If the circumstances are serious, the driver's qualification will be cancelled.

Twenty-sixth taxi management agencies and taxi operating enterprises should establish a complaint reporting system, open the way of complaint reporting, and accept complaints from passengers and drivers in a timely manner.

Complaints about taxi services should provide written materials, fare bills, vehicle numbers and other evidence. The complainant shall cooperate with the investigation of the taxi management agency; Refuse to cooperate, as the automatic withdrawal of complaints.

Twenty-seventh taxi management agencies and taxi operating enterprises shall complete the investigation and reply to the complainant within 15 working days from the date of accepting the complaint; If it should be investigated and handled by other departments, it should be transferred to the relevant departments in time.

After accepting the passenger complaints, the taxi management agency deems it necessary to investigate the taxi operators or drivers face to face, and may notify the relevant personnel to go to the taxi management agency for investigation together with the vehicles within the prescribed time limit.

Twenty-eighth taxi drivers have the responsibility to complain more than three times a year, taxi management agencies should suspend their qualifications and require them to re-participate in training; Only those who pass the examination can continue to engage in taxi business activities. Drivers who have been stopped for more than 2 times within one year may be disqualified by the taxi management agency.

Chapter V Legal Liability

Twenty-ninth in violation of the provisions of these measures, engaged in taxi business without approval, the taxi management agency shall order it to make corrections, confiscate the illegal income, and impose a fine of more than 20000 yuan per car 10000.

Thirtieth in violation of the provisions of these measures, the operator has one of the following acts, the taxi management agency shall order it to make corrections, and impose a fine of 2000 yuan to 1000 yuan:

(1) Failing to train drivers in relevant laws, safe operation and standardized services in accordance with regulations;

(two) the taxi to unqualified personnel to drive and operate;

(three) after the vehicle was complained, the complaint was not handled in time, or the relevant personnel did not go to the taxi management agency for investigation and handling within the prescribed time limit;

(four) 1 month, the number of people punished for violating these measures reached 3% of the total number of enterprise vehicles.

Thirty-first in violation of the provisions of these measures, units or individuals in the non passenger taxi operating signs or facilities, the taxi management agencies shall be ordered to make corrections, and impose a fine of 2000 yuan to 5000 yuan.

Thirty-second in violation of the provisions of these measures, taxi drivers engaged in business activities outside the approved operating area, the taxi management agency shall order them to make corrections and impose a fine of 1000 yuan.

Thirty-third in violation of the provisions of these measures, the taxi driver has one of the following acts, the taxi management agency shall order it to make corrections, and impose a fine of 3000 yuan to 1000 yuan:

(a) driving a taxi without a qualification certificate;

(2) Refusing to carry passengers or jointly carrying passengers;

(three) passengers deliberately detour or exorbitant prices;

(4) Transferring passengers to others for transportation without justifiable reasons.

In violation of the provisions of items (2), (3) and (4) of this article, if the circumstances are serious, the driver's license may be suspended 1 to 6 months; If the circumstances are particularly serious, you can cancel your driving qualification.

Thirty-fourth in violation of the provisions of these measures, the operator or driver has one of the following acts, the taxi management agency shall order it to make corrections and impose a fine on 500 yuan:

(a) failing to inspect the vehicle in accordance with the provisions or continuing to operate if the vehicle fails to pass the inspection;

(two) the car body decoration is not sprayed or the color of the car body is changed without authorization;

(three) failing to install or return the taxi anti-counterfeiting mark in accordance with the provisions.

Thirty-fifth in violation of the provisions of these measures, the taxi driver has one of the following acts, the taxi management agency shall order it to make corrections, and impose a fine of more than 300 yuan 100 yuan:

(1) Failing to use the operating facilities such as the overhead lights of passenger taxis, empty rental signs, etc. in accordance with the provisions;

(two) failing to post the charging standard at the designated position in the car in accordance with the regulations;

(3) Setting up publicity materials or advertisements on passenger taxis without approval;

(four) failing to carry the operation license, qualification certificate or place the driver's license in accordance with the provisions;

(five) the vehicle is inconsistent with the industrial and commercial registration;

(six) in the airport, station and other taxi business stations, special waiting areas, do not obey the command, do not get on or off passengers in designated areas, do not queue up to carry passengers in order or leave the vehicle to attract passengers;

(7) Failing to pay special bills or continuing to operate without special bills;

(eight) did not participate in the service quality credit assessment in accordance with the provisions;

(nine) the use of car intercom facilities to spread and receive information unrelated to the operation;

(ten) the operation service does not meet the industry service standards.

Article 36 If a taxi driver insults or beats passengers or management personnel in the course of operation, or there are other situations that violate the provisions of these Measures, if the circumstances are serious, the taxi management agency will suspend the driver's qualification certificate 1 to 6 months; If the circumstances are particularly serious, you can cancel your driving qualification.

Article 37 For acts that cannot be dealt with on the spot in violation of the provisions of these Measures, the taxi management institution may temporarily withhold the relevant operation certificates and issue the certificates to be managed as the certificates for its continued operation. For those who refuse to accept the inspection, the vehicle may be temporarily detained, and a withholding certificate shall be issued to the parties to inform the law enforcement basis, reasons and the time limit and place for accepting the treatment.

The parties concerned shall go to the designated place for investigation and handling within the prescribed time limit. Refusing to accept the investigation and handling within the time limit, the taxi management institution may make an administrative punishment decision according to law and serve the punishment decision on the parties concerned.

Thirty-eighth taxi management agencies should properly keep the vehicles temporarily detained according to law. If the vehicle is temporarily detained for no more than 7 days, the storage fee will be exempted; For more than 7 days, the parties concerned shall pay the safekeeping fee according to the standards approved by the price department. If a party fails to perform the decision on administrative punishment within the time limit without justifiable reasons, the taxi management institution may auction the temporarily detained vehicle according to law, and the balance will be returned to the party after the auction price is deducted from the auction fees, the storage fee, fine and late payment fee during the temporarily detained period.

Thirty-ninth taxi managers should enforce the law impartially and manage it in a civilized way. Breach of privilege, corruption, dereliction of duty, shall be given administrative sanctions by their units or relevant departments; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VI Supplementary Provisions

Article 40 Refusal to load as mentioned in these Measures refers to the following acts:

(a) after the running vehicle turns on the empty sign light, the passengers wave not to carry passengers;

(two) after turning on the empty sign light, the driving vehicle refuses to carry it at the passenger collection and distribution point or the roadside for rent;

(3) Failing to pick up the guests at the specified time and place according to the requirements of car rental reservation without justifiable reasons;

(four) in the passenger transport operation, without justifiable reasons to jilt or jilt passengers.

Article 41 These Measures shall be implemented as of 2011121. "Several Provisions on the Administration of Taxi Market in Shenyang" (No.42 [2000] of the municipal government) shall be abolished at the same time.
