What procedures and materials are needed for marriage registration?
The marriage registration procedure is mainly composed of application, examination and registration.
(1) application
Those who meet the conditions for marriage registration, bring relevant certification materials and registration photos, apply for marriage registration at the marriage registration office where one party is located, and fill in the application registration statement according to the guidance of the staff.
The preparation materials for marriage registration application depend on the specific circumstances. For example, when China citizens apply for marriage in China, they need to hold their ID card, household registration book, marriage examination certificate, a signed statement that they have no spouse and no lineal blood relationship with each other and collateral blood relationship within three generations, and divorce certificates are required.
Foreigners who apply for marriage in China (including China people, foreigners who come to China permanently or temporarily, and foreigners who have settled in China) must hold their valid passports, the Alien Residence Permit issued by the public security organs, and the certificate of marital status issued by our notary office certified by the Ministry of Foreign Affairs (or authorized by the Ministry of Foreign Affairs) and our embassy or consulate in that country.
(2) Review
The marriage registration office will examine the application of the parties to find out whether the marriage application submitted is within the conditions. If the application materials submitted by the parties are unknown, the marriage registration authority shall ask the parties and ask them to provide materials related to the application for marriage registration when necessary.
(3) Registration and licensing
The marriage registration authority shall register those who meet the conditions for marriage and issue a marriage certificate; For divorced people who want to remarry, the marriage registration office will cancel their divorce certificates; For those who do not meet the conditions for marriage registration, the marriage registration authority will issue a notice of disapproval of marriage registration according to the requirements of the parties, explaining the reasons for disapproval.
What procedures and documents do you need for divorce?
The process of divorce registration is roughly as follows:
(1) application
If both parties voluntarily divorce, they need to sign a divorce agreement as required, apply to the marriage registration authority (which has jurisdiction), and provide the following documents and supporting materials as required:
1, marriage certificate issued by mainland marriage registration authority or Chinese embassy (consulate) abroad;
2. Relevant valid identity documents that meet the requirements, such as my ID card, household registration book, pass, passport or other valid international travel documents;
3. Fill in the application for divorce registration.
(2) Accept
The staff of the marriage registration office will conduct a preliminary examination of the application materials submitted by both husband and wife as required. After checking the documents and supporting materials submitted by the parties for the first time, the marriage registrar will issue a receipt for accepting the divorce registration application. If the application conditions for divorce registration are not met, the divorce shall not be accepted, and the parties may request to issue a notice of rejection of the application for divorce registration.
(3) cooling-off period
Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues a receipt for accepting the application for divorce registration to the parties concerned, any party who does not want to divorce can withdraw the previously submitted application for divorce registration to the divorce registration office that accepts the application for divorce registration with his valid identity certificate and the receipt for accepting the application for divorce registration (if the receipt cannot be found, a written explanation can be given), and fill out the Application for Withdrawal of Divorce Registration in person. After verification by the marriage registration authority, a Confirmation Letter for Withdrawing the Application for Divorce Registration will be issued. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to apply for a divorce certificate at the marriage registration office, the application for divorce registration shall be deemed to have been withdrawn.
(4) Review
Within 30 days after the end of the cooling-off period of divorce (if the last day of the period expires is a holiday, the first day after the holiday is the expiration date), divorced couples should carry valid certificates and materials according to relevant regulations, such as recent bareheaded photos of both parties, divorce agreement, marriage certificate, ID card, passport or pass, etc. , and apply to the marriage registration authority for a divorce certificate. The marriage registration authority shall conduct an examination according to the provisions of the Marriage Registration Code. Those who do not meet the conditions for divorce registration shall not be handled. If a party requests to issue a notice not to register for divorce, it shall issue it.
(5) Registration and issuance of divorce certificates
The marriage registration authority shall register and issue divorce certificates in accordance with regulations.
