There is an office, a market inspection office and a bidding supervision office, which are responsible for the bidding market management of housing construction and market infrastructure projects in Sichuan Province and the identification and management of bidding agencies in Sichuan Province.
In order to further standardize the successful bidding of Sichuan construction enterprises and formulate the relevant contents of project bidding, the qualification management of construction enterprises has been defined, which mainly includes: (1) general provisions, (2) qualification classification and grading, (3) qualification application and approval, (4) supervision and management, (5) punishment and (6) supplementary provisions, in which qualification application and approval consist of six parts.
Article 7 A construction enterprise shall apply for qualification to the construction administrative department of the local people's government at or above the county level where the enterprise is registered.
Enterprises managed by the central government directly apply to the administrative department of construction in the State Council for qualification, and their subordinate enterprises apply for the special-grade, first-class and professional-grade qualification of general construction contract. Enterprises managed by the central government apply to the administrative department of construction in the State Council, and at the same time file with the provincial administrative department of construction where the enterprise is registered.
(a) the application form for the qualification of construction enterprises;
(2) Business license of enterprise as a legal person;
(3) Articles of association of the enterprise;
(four) the title certificate and identity card of the legal representative of the enterprise and the person in charge of technology, finance and operation of the enterprise;
(5) Qualification certificate and ID card of enterprise project manager;
(six) the professional title certificate of enterprise engineering technology and economic management personnel;
(seven) other relevant documents and materials that need to be issued.
Article 9 To apply for qualification upgrading, a construction enterprise shall provide the following materials in addition to the materials listed in Article 8 of these Provisions to the construction administrative department:
(a) the original and photocopy of the enterprise qualification certificate;
(2) Annual financial statements of the enterprise;
(three) the contract and quality acceptance and safety evaluation data of the representative project completed by the enterprise.
Article 10 The qualification of the first-class construction general contracting sequence and the first-class enterprises and the first-class professional contracting sequence enterprises (excluding the enterprises listed in the second paragraph of Article 7 of these Provisions) shall be examined and approved by the the State Council municipal construction administrative department; The qualifications of construction enterprises in railway, transportation, water conservancy, information industry, civil aviation, etc. shall be reviewed by the provincial construction administrative department in consultation with the relevant departments at the same level, reported to the the State Council construction administrative department, and approved by the relevant departments in the State Council, and examined and approved by the the State Council construction administrative department. The audit department shall audit the qualification conditions of the construction enterprise and the information provided by the qualification application.
The qualification of general contracting sequence and professional contracting sequence enterprises for projects of Grade II and below shall be examined and approved by the construction administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government where the enterprise is registered; Among them, the qualification of transportation, water conservancy and communication construction enterprises shall be examined and approved by the construction administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government after obtaining the consent of the relevant departments at the same level.
The qualification of a subcontracting enterprise shall be examined and approved by the construction administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government where the enterprise is located.
Eleventh construction administrative departments shall complete the qualification examination and approval of construction enterprises within 60 days from the date of accepting the application of construction enterprises.
If the relevant departments are responsible for the preliminary examination, the preliminary examination department shall complete the preliminary examination within 20 days from the date of receiving the application from the construction enterprise; The construction administrative department shall complete the examination and approval within 30 days from the date of receiving the preliminary examination materials, and notify the preliminary examination department of the examination and approval results.
The construction administrative department shall publish the examination and approval results in the public media.
Article 12 The qualification grade of a newly established construction enterprise shall be approved according to the lowest grade, tentatively for one year.
Where a construction enterprise is established due to enterprise restructuring or enterprise division or merger, its qualification level shall be verified according to the actual qualification conditions and in accordance with the examination and approval procedures specified in these Provisions.
Article 13 A construction enterprise applying for the qualification of general contracting of construction shall choose one type of qualification as the main qualification in the general contracting sequence, and may apply for other types of qualifications not higher than the main qualification level of the general contracting sequence of the enterprise, or apply for professional contracting qualifications not higher than the main qualification level of the enterprise. If a general contracting enterprise undertakes professional projects within the scope of the general contracting project, it may not apply for the corresponding professional contracting qualification.
Professional contracting enterprises and labor subcontracting enterprises can apply for qualifications with similar categories in this qualification sequence.
Fourteenth construction enterprises to apply for promotion of qualification level or qualification other than the main qualification, within one year before the date of application, one of the following acts, the construction administrative department shall not approve:
(a) colluding with the construction unit or enterprise in bidding, or winning the bid by bribery or other improper means;
(two) without obtaining a construction permit for construction;
(3) Subcontracting the contracted project or subcontracting it illegally;
(four) a serious violation of the national mandatory standards for engineering construction;
(5) Major quality and safety accidents have occurred in three or more projects under construction or two or more quality and safety accidents have occurred in four or more projects under construction;
(six) concealing or misrepresenting, delaying the report of engineering quality and safety accidents or destroying the scene of the accident or obstructing the investigation of the accident;
(seven) in accordance with the provisions of the state, the technical type of work operators who need certificates have not been trained and examined, and have not obtained certificates, and the circumstances are serious;
(eight) did not fulfill the warranty obligations, causing serious consequences;
(nine) in violation of the relevant state laws and regulations on production safety and technical regulations on production safety, and the circumstances are serious;
(ten) other acts in violation of laws and regulations.
Fifteenth construction enterprises meet the qualification standards, and there is no behavior listed in Article fourteenth of these Provisions, the construction administrative department issued the corresponding qualification level of the "construction enterprise qualification certificate".
"Construction Enterprise Qualification Certificate" is divided into an original and a copy, which are uniformly printed by the construction administrative department of the State Council, and the original and the copy have the same legal effect.
Article 16 No unit or individual may alter, forge, lend or transfer the qualification certificate of a construction enterprise; Shall not illegally detain or confiscate the qualification certificate of the construction enterprise.
Seventeenth construction enterprises to receive a new "construction enterprise qualification certificate", it should also return the original qualification certificate to the original issuing authority for cancellation.
Where a construction enterprise goes bankrupt, closes down, cancels or closes down, it shall return the qualification certificate to the original issuing authority for cancellation.
Article 8 A newly established construction enterprise may register with the administrative department for industry and commerce and obtain the business license of enterprise as a legal person, and then go to the administrative department for construction to handle the information.
