Measures of Zhejiang Province for the Administration of Residential House Lease Registration

Chapter I General Provisions Article 1 In order to strengthen the management of residential housing lease, protect the legitimate rights and interests of the parties and maintain social order, these measures are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on Public Security Administration Punishment, the Regulations of Zhejiang Province on the Residence Registration of Floating Population and other relevant laws and regulations, and in combination with the actual situation of this province. Article 2 These Measures shall apply to the registration and administration of residential housing lease within the administrative area of this province.

The term "residential houses" as mentioned in these Measures refers to houses that are used or used for living after being rented. Hotel rooms, low-rent housing and public rental housing are excluded.

The term "residential housing lease registration" as mentioned in these Measures refers to the activities of submitting, recording and managing the relevant information of the parties to residential housing lease in accordance with the provisions of these Measures. Article 3 The people's governments at or above the county level shall strengthen the leadership and comprehensive coordination of the management of residential housing lease registration, ensure the funds and personnel needed for the work, and promote the informatization construction of population management and the integrated utilization of information resources.

Township people's governments and sub-district offices shall do a good job in the registration of residential housing lease in accordance with relevant regulations. Article 4 The public security organ of the people's government at or above the county level (hereinafter referred to as the public security organ) is in charge of the registration of residential house lease; According to the needs, the people's governments at or above the county level may entrust the institutions that undertake the service management of floating population (hereinafter referred to as service management institutions) to engage in specific affairs such as registration services.

The departments of housing and urban and rural construction, human resources and social security, population and family planning, and industrial and commercial administration of the people's governments at or above the county level shall do a good job in the registration and management of residential housing lease in accordance with their respective responsibilities. Fifth residents' committees, villagers' committees, real estate intermediary service agencies, property service enterprises and relevant employers shall assist in the registration of residential housing lease. Chapter II Registration Administration Article 6 The lessor shall, within 3 working days from the date of renting the residential house, submit the following materials in accordance with the provisions of Article 7 of these Measures:

(1) The lessor's name, citizenship number, work unit and contact information, the lessee's name, type and number of identity documents, gender, nationality, household registration address, work unit and contact information, etc. ;

(2) Basic information such as residential address, lease term and use function.

If the lessee is a floating population, the lessor shall submit or inform the floating population information in accordance with the Regulations on Residence Registration of Floating Population in Zhejiang Province.

Where the lessor and the lessee terminate the residential housing lease relationship, the lessor shall, within 3 working days from the date of termination of the residential housing lease relationship, submit the list of lessees in accordance with the provisions of Article 7 of these Measures. Article 7 The lessor may submit the information specified in Article 6 of these Measures to the public security organ or the service management institution in the following ways:

(a) submitted through the public security organs or service management institutions opened by fax, Internet and other channels;

(2) Submit relevant information to the residents' committee or villagers' committee where the realty service enterprise or residential house is located, and the realty service enterprise or residents' committee or villagers' committee shall forward the report to the public security organ or service management institution;

(three) by the real estate intermediary service agencies for the lessor to introduce residential housing rental to public security organs or service management agencies;

(four) to report to the grass-roots working institutions of the public security police station or service management institutions.

Where the public security organ or service management institution comes to handle the registration of residential housing lease, the lessor and lessee shall cooperate, take the initiative to show their identity documents and truthfully declare the relevant information as stipulated in Article 6 of these Measures. Article 8 A realty service enterprise shall, within 3 working days, transfer the information submitted by the lessor to the public security organ or the service management institution.

Real estate intermediary service institutions shall, within three working days from the date of completing the introduction of residential housing leasing business, submit the relevant information of the parties to residential housing leasing and the basic situation of residential housing to the public security organs or service management institutions, or residents' committees and villagers' committees. Article 9 The residents' committees and villagers' committees shall timely transfer the information submitted by lessors and real estate intermediary service agencies to public security organs or service management agencies.

Township people's governments and sub-district offices shall guide, support, help and urge residents' committees and villagers' committees to carry out the work specified in the preceding paragraph. Article 10 The public security organ or service management institution shall publicize the contents, basis, required materials and handling procedures of residential house lease registration to the public on its website and handling point, provide registration forms and fill in samples, and provide convenient services for the parties involved in residential house lease.

The housing and urban-rural construction department shall, jointly with relevant departments, formulate and publish a model text of the residential housing lease contract, and guide and standardize the signing and performance of the residential housing lease contract.

The public security organ or the service management institution shall not charge fees for providing services to the parties to the lease of residential houses. Eleventh public security organs or service management institutions shall inform the parties of their obligations and related responsibilities in accordance with the law by distributing information and signing a letter of responsibility for public security with the lessor, and strengthen legal publicity and education. Twelfth public security organs or service management institutions shall comprehensively, timely and accurately collect the dynamic information of residential housing lease.

The management personnel who come to handle the registration of residential housing lease shall show their certificates and strictly abide by the work discipline.
