Regulations of Jingzhou Municipality on the Prevention and Control of Dust Pollution

Chapter I General Provisions Article 1 In order to effectively prevent and control dust pollution, protect and improve the atmospheric environment, safeguard public health, promote the construction of ecological civilization, and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Law on the Prevention and Control of Air Pollution in People's Republic of China (PRC), the Regulations on the Prevention and Control of Air Pollution in Hubei Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention and control of dust pollution and its supervision and management activities within the administrative area of this Municipality. Article 3 The term "dust pollution" as mentioned in these Regulations refers to the pollution of the atmospheric environment caused by dust particles generated by construction projects, building demolition, material stacking and transportation, greening construction, road cleaning and mining. Article 4 The prevention and control of dust pollution shall adhere to the principles of giving priority to prevention, combining prevention with control, comprehensive treatment and bearing the responsibility for damage, and implement the mechanism of government leading, departmental supervision, territorial management and public participation. Article 5 The municipal and county people's governments shall be responsible for the prevention and control of dust pollution within their respective jurisdictions and perform the following duties:

(a) to formulate action plans and annual work plans for the prevention and control of dust pollution;

(two) the establishment of dust pollution prevention and control coordination, long-term management and capital investment guarantee mechanism;

(three) the establishment of public monitoring and early warning mechanism, organize the formulation of emergency plans;

(four) to establish and improve the supervision and inspection, assessment and accountability system for the prevention and control of dust pollution;

(five) other duties as prescribed by laws and regulations.

Jingzhou Economic and Technological Development Zone Management Committee, Jingzhou Jinan Eco-cultural Tourism Zone Management Committee and Jingzhou Hi-tech Industrial Development Zone Management Committee are responsible for the prevention and control of dust pollution in their respective regions according to their functions and powers.

Township people's governments and sub-district offices shall be responsible for the prevention and control of dust pollution within their respective jurisdictions in accordance with the provisions of laws and regulations and the requirements of the people's governments at higher levels.

Village (neighborhood) committees shall assist in the prevention and control of dust pollution. Article 6 The ecological and environmental departments shall exercise unified supervision and management over the prevention and control of dust pollution, coordinate and urge other relevant departments to perform their duties of prevention and control of dust pollution, and jointly identify and announce key dust pollution sources with relevant departments; Responsible for the supervision and management of dust pollution prevention in the material yard of industrial enterprises. Seventh housing and urban-rural construction departments are responsible for the supervision and management of dust pollution prevention and control in housing construction, municipal infrastructure, building (structure) demolition and other engineering construction.

The house expropriation department determined by the people's government at the city or county level is responsible for the supervision and management of dust pollution prevention and control of shantytown renovation projects in the central city.

The urban management department is responsible for the supervision and management of the prevention and control of dust pollution, the demolition of illegal buildings (structures), the greening and cleaning of municipal roads, and the collection, removal and treatment of domestic garbage during the transportation of construction waste, gravel, concrete and other materials.

The transportation department is responsible for the construction, maintenance and management of transportation facilities, as well as the supervision and management of the prevention and control of dust pollution in port and dock material yards.

The public security traffic management department is responsible for examining and determining the driving routes and transit times of transport vehicles prone to dust pollution, and investigating and handling the above traffic violations.

The water conservancy department is responsible for the supervision and management of dust pollution prevention and control in water conservancy project construction.

Other departments are responsible for the supervision and management of dust pollution prevention and control within their respective responsibilities. Chapter II Prevention and Control Measures Article 8 The subject responsible for the prevention and control of dust pollution shall establish a management system for the prevention and control of dust pollution and take corresponding prevention and control measures. Article 9 The construction unit shall specify the responsibility of the construction unit for dust pollution prevention and control in the construction contract, and include the dust pollution prevention and control expenses as uncompetitive expenses in the project cost, which shall be specially used for dust pollution prevention and control. Tenth construction units shall formulate plans for the prevention and control of dust pollution, according to the law to the corresponding dust pollution prevention and control supervision and management departments for the record, and the implementation of prevention and control measures.

The construction unit shall publicize information such as dust pollution prevention measures, responsible persons and supervision and management departments at the construction site. Eleventh supervision units shall incorporate the prevention and control measures of construction dust pollution into the scope of supervision, and supervise the implementation; For those that have not been implemented, the construction unit is required to correct immediately and report to the construction unit and relevant management departments in time. Twelfth engineering construction shall meet the following general requirements for the prevention and control of dust pollution:

(a) around the construction site in accordance with the requirements of the specification set up a hard, continuous closed enclosure, urban trunk roads, landscape areas, busy areas of the construction enclosure height not less than 250 cm, the general road construction enclosure height not less than 180 cm;

(2) Spray and spray facilities shall be uniformly installed on the main roads, enclosures, the periphery of the main structure of buildings and other parts that produce dust pollution, and spraying can effectively cover the dust-proof area;

(3) When carrying out earthwork, foundation construction, demolition, blasting, mechanical planing, material cutting, loading and unloading, moving materials and other operations that are easy to generate dust, adopt continuous pressurized spraying or other measures to suppress dust generation;

(4) Materials that are easy to generate dust, such as sand and gravel, earthwork and construction waste, are piled on the construction site, and measures such as regular watering are taken. If it is not used or removed within 48 hours, it shall be completely covered with dust-proof net, dust-proof cloth and other measures;

(five) due to the time when the construction operation is exposed to the ground, if the operation is not carried out for more than 48 hours, dust prevention measures such as covering shall be taken, and if the construction is not carried out for more than three months, greening and paving shall be carried out;

(6) The inside of the entrance to the construction site is equipped with washing equipment. For projects with foundation pit excavation and earthwork transportation, a vehicle washing pool is set to wash vehicles out of the construction site;

(seven) the ground of the entrance and exit of the construction site, the roadway and the material processing and stacking area shall be hardened in accordance with the regulations, and cleaned by sprinkling water;

(8) Ready-mixed concrete, ready-mixed graded macadam and ready-mixed water-stable mixture are used in the construction site, and mortar shall not be mixed in the construction site of urban built-up areas;

(nine) other measures stipulated by laws and regulations.
