Without permission, no unit or individual may engage in labor dispatch business. 2. Legal basis: Article 57 of People's Republic of China (PRC) Labor Contract Law.
To engage in labor dispatch business, the following conditions shall be met:
(1) The registered capital is not less than RMB 2 million;
(2) Having a fixed business place and facilities suitable for business development;
(3) Having a labor dispatch management system that complies with laws and administrative regulations;
(4) Other conditions stipulated by laws and administrative regulations.
Second, does labor outsourcing require qualifications?
Labor outsourcing needs capital. According to the relevant regulations, all projects that implement labor subcontracting must have labor qualifications. Units contracting construction projects shall hold qualification certificates obtained according to law and undertake projects within the business scope permitted by their qualification grades. Construction enterprises are prohibited from exceeding the business scope permitted by their qualification grades or contracting projects in the name of other construction enterprises in any form.
