Regulations of Liaoning Province on Green Building

Chapter I General Provisions Article 1 In order to implement the concept of green development, promote the modernization, intensive and regional development of green buildings, accelerate the structural reform of the supply side of the construction industry, promote the conservation and utilization of resources, and improve the living environment, in accordance with the People's Republic of China (PRC) Building Law, People's Republic of China (PRC) Energy Conservation Law, the State Council Civil Building Energy Conservation Regulations and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the planning, construction, operation, transformation, supervision, management, guidance and encouragement of green buildings within the administrative area of this province. Article 3 The people's governments of provinces, cities and counties (including county-level cities and districts, the same below) shall promote the development of green buildings, bring them into the national economic and social development plan, and implement the target responsibility system and evaluation system for green buildings. Article 4 The competent departments of housing and urban and rural construction of provinces, cities and counties (hereinafter referred to as the competent departments of housing and urban and rural construction) shall exercise unified supervision and management over the green building work within their respective administrative areas.

Development and reform, education, science and technology, industry and information technology, civil affairs, finance, human resources and social security, natural resources, ecological environment, transportation, agriculture and rural areas, taxation, market supervision and management, government administration and other relevant departments shall, within their respective functions and duties, supervise and manage the green building work according to law. Article 5 The people's governments of provinces, cities and counties shall include the funds for supervision and management of green buildings in the fiscal budget at the corresponding level.

Provincial, municipal and county people's governments shall organize housing and urban and rural construction, development and reform, natural resources and other departments to prepare green building development plans, arrange green building funds according to law, and support the development of green buildings. Article 6 The people's governments of provinces, cities and counties shall encourage and support the research, development, demonstration, popularization, publicity and education of green building technology, and promote the progress and innovation of green building technology.

The competent department of housing and urban and rural construction shall incorporate the relevant knowledge of green building into the training content of relevant employees, and improve the professional and technical level of employees.

Units and individuals that have made remarkable achievements in green building work shall be commended and rewarded in accordance with relevant state regulations. Seventh housing and urban and rural construction departments should coordinate with the relevant departments of industry and information technology, market supervision and management, and strengthen the supervision and management of the production, sales and use of materials and equipment used in green buildings. Chapter II Planning and Construction Article 8 The competent department of housing and urban and rural construction shall, in accordance with the national economic and social development plan and in combination with the actual needs of urban construction and economic development, organize the preparation of green building development plans, which shall be implemented after being approved by the people's government at the same level.

The competent department of urban and rural planning shall incorporate the contents of green building planning into the overall planning and detailed planning of cities and towns.

The competent department of housing and urban-rural construction of the province shall, according to the relevant technical standards of the state and in combination with the actual situation of this province, formulate green building standards and announce them to the public. Ninth new civil buildings (except self-built houses in rural areas) within the scope of construction land determined by the overall planning of cities and towns shall be planned and built in accordance with the green building standards. Tenth new civil construction project feasibility study report or project application report shall include the requirements of green building grade, clear the project selection of green building technology and investment, energy saving and emission reduction benefit evaluation and other content.

The approval documents for construction projects issued by the competent investment department shall specify the requirements for green building grades. Eleventh urban and rural planning departments should specify the requirements of green buildings in the planning conditions of land transfer. Twelfth construction units shall, in accordance with the provisions, publicize the information on energy saving, water saving, land saving, material saving and environmental protection of green buildings in a prominent position on the construction site.

Real estate development enterprises should clearly indicate the information of green building grade and main technical indicators at the sales site, and specify the information of energy saving, water saving, land saving and material saving, and the warranty period and protection requirements of facilities and equipment in the commercial housing sales contract, residential quality guarantee and residential use instructions. Thirteenth design units should design in accordance with the standards of green buildings, and provide special articles on green buildings. The building materials, building components, facilities and equipment selected for the project shall meet the requirements of green building standards.

Newly-built office buildings of state organs and large-scale public buildings shall be equipped with devices for measuring and collecting and transmitting usable water items for buildings, and the energy efficiency of civil buildings shall be evaluated and marked.

Encourage new residential buildings and non-government investment projects to carry out energy-saving assessment and identification of civil buildings. Fourteenth construction drawing design documents review institutions shall review the construction drawing design documents in accordance with the green building standards; No examination certificate shall be issued for the construction drawing design documents that do not meet the green building standards. Article 15 The construction unit shall prepare a special construction plan for green buildings and carry out the construction according to the construction drawing design documents, and shall not use building materials, building components and facilities such as wall materials, insulation materials, doors and windows, heating and refrigeration systems, lighting equipment, non-traditional water facilities, renewable energy utilization facilities and water-saving appliances that do not meet the requirements of the construction drawing design documents.

The construction unit shall take energy-saving emission reduction and environmental protection measures such as reducing construction energy consumption and water consumption, reducing waste discharge, reducing noise pollution and preventing dust. Dust control costs are included in the project cost.
