Is it illegal to work in an emotional counseling company?

Legal analysis: illegal. The labor law regulates the labor relations between employers and workers. Disputes between employees and customers during work do not belong to labor relations, and there is no relevant provision in the Labor Law.

If there is a dispute between employees and customers during work, the unit will deal with the workers according to the rules and regulations of the unit, and then the labor law will play a role. If in a case, the laborer thinks that the rules and regulations of the employing unit have violated his legitimate rights and interests, he can ask the trade union for supervision and correction, or apply for labor arbitration until litigation.

Legal basis: In case of any of the following circumstances in Article 44 of the Labor Law of People's Republic of China (PRC), the employing unit shall pay wages higher than the wages of the workers during normal working hours according to the following standards:

(1) If the laborer is arranged to work longer hours, he shall be paid no less than 150% of the salary;

(2) If workers are arranged to work on rest days but cannot be arranged for compensatory time off, they shall be paid a salary of not less than 200% of their wages;

(3) If workers are arranged to work on legal holidays, they shall be paid no less than 300% of their wages.
