Measures of Harbin Municipality on the Administration of Urban Road Freight Transportation Services

Chapter I General Provisions Article 1 In order to strengthen the management of urban road freight transport services, maintain the order of the transport market, safeguard the legitimate rights and interests of road transport operators and users, and promote economic development, these measures are formulated in accordance with the Regulations of Heilongjiang Province on the Administration of Road Transport and other relevant provisions, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the administration of motor vehicle road freight transport services in the urban areas of this Municipality. Article 3 The term "road freight transport services" as mentioned in these Measures refers to:

(a) engaged in vehicle loading (that is, empty car loading), cargo transport and other cargo handling services business activities.

(two) engaged in the business activities of less-than-truckload cargo transportation, van freight car rental, motor vehicle rental and other transportation services. Article 4 The municipal traffic administrative department is the competent department of road freight transport services, and is responsible for organizing the implementation of these Measures. The municipal road transport management institution to which it belongs is responsible for daily management.

The administrative departments of industry and commerce, public security, municipal administration and price shall, in accordance with their respective responsibilities, coordinate in the management of road freight transport services. Chapter II Conditions for Opening Business Article 5 Units and individuals engaged in motor vehicle road freight transport services (hereinafter referred to as operators) shall meet the general conditions such as facilities, venues, funds and personnel stipulated in the Technical and Economic Conditions for Opening Road Transport Services (Trial) issued by the Ministry of Communications. Article 6 To carry out the following business, in addition to the general conditions stipulated in Article 5 of these Measures, the following conditions shall also be met:

(a) Use high guardrails or enclosed trucks to transport less-than-trucked goods;

(2) Cars engaged in van-type freight rental are equipped with van-type trucks of less than 2 tons (including 2 tons);

(3) Commercial vehicles engaged in delivery services shall have parking spaces suitable for their business scale;

(four) engaged in handling, with stable handling personnel and necessary handling tools;

(five) engaged in moving services, have their own transport vehicles;

(six) engaged in freight acceptance services, in the freight trading market or the approved cargo distribution center has business premises;

(seven) engaged in motor vehicle rental services, with a certain number of motor vehicles and parking lots;

(eight) engaged in warehousing and tally services, with an area of not less than 200 square meters of permanent warehouse or 1000 square meters of space. Seventh engaged in motor vehicle road freight transport services, shall apply to the municipal road transport management institution. Upon examination, those who meet the business conditions shall be issued a road transport business license, and shall register with the industrial and commercial administration and tax authorities with the road transport business license.

Engaged in inter-provincial, autonomous region, municipality directly under the central government and inter-city (region) cargo transportation, cargo stowage and international franchise line cargo transportation shall apply to the municipal road transport management institution, and after examination and approval, it shall be submitted to the provincial road transport management department for approval.

Units and individuals without approval shall not engage in business activities of road freight transport services. Chapter III Acceptance of Freight Article 8 Acceptance of freight refers to such activities as handling the transportation formalities for the consignor, delivering the goods on behalf of the consignor, organizing the supply of goods for the consignor, providing storage space for the goods, and providing vehicle and cargo information consulting services for the consignor and the consignor, including services such as acceptance of less-than-zero-load goods, loading of whole vehicles, combined transport of goods, freight information consulting, consignment packaging of goods, warehousing and tally. Article 9 Operators of LTL goods receiving services shall abide by the following provisions:

(a) The consigned goods shall not exceed 3 tons at a time;

(2) Check the identity documents, transport documents and transport vehicles of the carrier and register them before loading;

(three) signed the "Heilongjiang province automobile LTL waybill" with the shipper and the carrier, and fill in the LTL cargo list;

(four) set up a unified line concession sign and service item price list in an obvious position;

(5) Not accepting uninsured high-grade and high-value LTL goods;

(six) the goods shall not be handed over to vehicles that are not qualified for transportation. Tenth vehicle cargo stowage service operators shall comply with the following provisions:

(a) the stowage goods belong to the same shipper, and the consignment of goods exceeds 3 tons at a time;

(two) check the identity documents, transport documents and transport vehicles of the carrier before delivery, and register them;

(three) signed the "Heilongjiang road cargo waybill" with the carrier. Eleventh cargo transport service operators shall engage in business activities in accordance with the scope of services approved by the municipal road transport management institution. Twelfth freight information consulting service operators should provide timely and accurate freight information to operators who have obtained the qualification of freight service. Article 13 Operators engaged in consignment and packaging services of goods shall sign a consignment contract with the shipper and package the consigned goods in accordance with regulations. Article 14 Warehousing tally operators shall properly keep the goods according to their nature, storage conditions and expiration date. Fifteenth freight acceptance operators shall hand over the accepted transport business to cargo transport operators with legal qualifications.

When there is a freight quality accident of the accepted goods that requires compensation, the freight acceptance service operator shall make compensation first and then recover from the responsible party.
