The term "enterprise credit information" as mentioned in these Measures refers to the information formed by enterprises in their production, operation and service activities, which can be used to analyze and judge the credit status of enterprises.
The term "collection of enterprise credit information" as mentioned in these Measures refers to the collection, processing, disclosure, use and correction of enterprise credit information. Article 3 The collection of enterprise credit information shall follow the principles of objectivity, fairness and accuracy, and whoever provides it shall be responsible, safeguard the legitimate rights and interests of enterprises according to law, and protect state secrets and business secrets of enterprises. Article 4 People's governments at all levels shall strengthen the leadership and comprehensive coordination over the collection and management of enterprise credit information, and ensure the healthy development of enterprise credit information collection. Article 5 The Municipal Economic and Information Technology Commission is the credit management department of this Municipality, and is responsible for the guidance, coordination, supervision and management of the collection and management of enterprise credit information in this Municipality.
The relevant departments shall, in accordance with their respective responsibilities, cooperate in the management of enterprise credit information collection. Article 6 The public credit information center established by the Municipal People's Government (hereinafter referred to as the Municipal Credit Center) shall be responsible for the construction, maintenance and management of the enterprise credit basic data management system in this Municipality, and collect enterprise credit information in accordance with the provisions of these Measures. Article 7 A lawfully established enterprise credit information credit investigation agency (hereinafter referred to as the credit investigation agency) shall collect enterprise credit information through legal channels and carry out enterprise credit information credit investigation activities. Eighth to encourage enterprises to actively participate in enterprise credit information collection activities.
Encourage project development, enterprise investment, enterprise procurement, enterprise decision-making and other activities to use enterprise credit information. Chapter II Collection and Processing Article 9 The collection of enterprise credit information mainly includes enterprise identity information, credit information, public information and other information related to enterprise credit.
The specific directory of enterprise credit information shall be formulated separately by the credit management department in accordance with the relevant provisions. Tenth administrative organs, judicial organs, organizations exercising public management functions, public utilities and industry organizations (hereinafter referred to as information providers) shall provide enterprise credit information to the municipal credit center in a timely, accurate and complete manner, except those involving state secrets and commercial secrets. Eleventh the following information providers shall provide the municipal credit center with relevant enterprise credit information such as enterprise rewards and administrative penalties formed in the process of performing their duties:
(1) The industrial and commercial departments provide basic information on industrial and commercial registration, annual inspection, mortgage registration, industrial and commercial cases and well-known, famous and well-known trademarks;
(two) quality and technical supervision departments to provide enterprise organization code, all kinds of administrative licenses, provincial famous brand products, quality checks and other information;
(three) the tax authorities to provide information such as enterprise tax registration, enterprise tax credit rating, tax arrears;
(four) information provided by the public security department related to the qualification and administrative license of the hotel industry;
(5) The environmental protection department shall provide the business license, radiation safety license, environmental behavior and other information of enterprise hazardous waste;
(six) human resources and social security departments to provide information such as the signing and performance of labor contracts, enterprise payment and arrears of wages;
(seven) the enterprise qualification information provided by the construction department;
(eight) the food and drug supervision department provides information such as the production and operation license of the pharmaceutical enterprise and the credit rating of drug safety;
(9) Entry-exit inspection and quarantine departments provide information such as exemption from inspection, registration, packaging permission, and filing of export food production enterprises;
(ten) the financial sector to provide enterprise loan card issuance information, financial credit rating, financial violations and other information;
(eleven) the safety production supervision department shall provide information on the safety production, operation and management of enterprises.
Other information providers such as credit information, development and reform, civil affairs, telecommunications, science and technology, agriculture, commerce, prices, statistics, culture, customs, food, transportation, education, health, municipal garden departments, judicial organs, etc. shall provide relevant enterprise credit information to the Municipal Credit Center in accordance with the agreement. Twelfth city credit center in addition to collecting enterprise credit information provided by information providers, can collect enterprise credit information by the following ways:
(1) Credit information related to enterprises in this Municipality obtained directly from other information systems;
(2) Collecting enterprise credit information held by financial institutions in financial activities in an agreed way;
(3) Collecting enterprise credit information obtained from credit reporting agencies in an agreed way;
(four) directly to the enterprise or enterprise transaction object in the agreed way. Thirteenth credit institutions can collect enterprise credit information by themselves in the following ways:
(a) Information published by the media;
(two) provided by the municipal credit center in an agreed way;
(three) directly to the enterprise or enterprise transaction object in the agreed way.
It is forbidden to collect enterprise credit information by cheating, stealing, coercion, computer network intrusion and other improper means.
