Is it legal for the landlord to charge the facade transfer fee?

The store rent is the rental fee paid by the tenant to the landlord, while the store transfer fee is the extra fee paid by the tenant to the last operator. This money has not fallen into the hands of the real landlord. So tracing back to the source, the first tenant of the store rented it directly from the real landlord. As long as he pays the rent, there is no transfer fee for the shop. From the second time, the transfer fee of the store will be passed on to the next tenant. In the process of continuous subletting, the transfer fee of shops is raised step by step, and the more times shops change hands, the higher the transfer fee will be.

At present, the current laws and regulations in China do not clearly stipulate that the transfer fee cannot be charged, so it is a private agreement between the owner and the lessee to charge the transfer fee. However, the premise of collecting the transfer fee should be that the transfer is legal. It should be approved by the landlord before it can be transferred. According to the relevant provisions of China's civil law and contract law, subletting requires the consent of the landlord, otherwise subletting is not allowed, let alone charging a transfer fee.
