Chapter I General Provisions Article 1 In order to strengthen the supervision of engineering construction, ensure the engineering quality, improve the engineering construction level and investment benefit, and safeguard the legitimate rights and interests of the construction unit and the supervised unit, these Regulations are formulated in accordance with the Construction Law of People's Republic of China (PRC) and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 The term "project construction supervision" as mentioned in these Regulations refers to the supervision and management of project demonstration, project design, project quality, construction period and the use of construction funds by legally established supervision units. Entrusted by the construction unit in accordance with relevant laws, regulations, technical standards, construction supervision contracts and other engineering construction contracts. Article 3 Those who engage in engineering construction supervision activities within the administrative area of this Municipality shall abide by these Regulations. Fourth municipal construction administrative departments centralized management of the city's engineering construction supervision projects.

Other relevant administrative departments shall, in accordance with the relevant laws, regulations and the provisions of this Ordinance, manage the engineering construction supervision of their own departments. Fifth engineering construction supervision activities should follow the principles of objectivity, impartiality, independence and autonomy. Article 6 Any unit or individual has the right to report acts in violation of the provisions of these Regulations.

After receiving the report, the relevant authorities shall promptly deal with it, keep the informer confidential, and reward those who report meritorious service. Chapter II Scope and Contents of Supervision Article 7 The following construction projects shall be subject to supervision:

(a) national, provincial and municipal key projects;

(2) Large and medium-sized industrial construction projects;

(three) transportation, water conservancy, urban infrastructure and various civil construction projects with a project cost of more than 2 million yuan or a construction area of more than 2,000 square meters;

(four) building decoration projects with a total investment of more than 6.5438 million yuan;

(five) other projects that should be supervised according to law. Article 8 Supervision is divided into prophase, design, construction and other stages.

The construction unit may entrust the supervision unit to supervise all stages of the project as required, and may also supervise some stages.

The construction projects specified in Article 7 of these Regulations must be supervised during the construction stage. Article 9 The main contents of pre-supervision include pre-decision consultation and feasibility study consultation of investment projects.

The main contents of supervision in the design stage include participating in the selection of design scheme, assisting the construction unit to determine the design unit, signing the design contract, reviewing the design drawings and reviewing the design budget (budget).

The main contents of supervision in the construction stage include:

(a) to assist the construction unit to formulate the construction bidding scheme;

(two) review the project schedule, project quality, investment control scheme and guarantee measures, and urge the construction unit to implement it;

(three) the quality control of raw materials, finished products, semi-finished products, components and equipment used in the project, as well as the quality inspection and acceptance of disciplines, divisions and units;

(4) visas for various technical and economic documents;

(five) to participate in the project completion acceptance and project settlement review, and do a good job in project warranty supervision. Chapter III Supervision Management Article 10 To set up a supervision unit, an application shall be submitted to the relevant administrative department in accordance with the relevant provisions of the state, and after approval, it shall be filed with the municipal construction administrative department, and apply for registration with the municipal administrative department for industry and commerce to obtain a business license. Eleventh the establishment of a supervision unit shall meet the following conditions:

(1) Having a clear name, articles of association, organization and place;

(2) Having a registered capital that meets the requirements of the law;

(three) there are more than ten personnel holding the qualification certificate of supervision engineer, including not less than two full-time senior engineers or senior architects and not less than zero senior economists;

(4) Having the technical equipment necessary for engaging in engineering supervision activities;

(5) Other conditions stipulated by laws and regulations. Twelfth supervision units outside the city to undertake supervision business in this city, should go through the registration formalities in the municipal construction administrative department. Thirteenth supervision units shall undertake supervision business in strict accordance with the qualification level and business scope.

Supervision units and construction units, design units and construction units shall not belong to the same business entity, and shall not have affiliation or other interests.

The supervision unit and the contractor of the supervised project, the supplier of building materials, building components and equipment shall not have affiliation or other interests.

The supervision unit shall not transfer the supervision business. Fourteenth the provisions of this Ordinance to implement supervision of the project, the supervision unit should be selected by bidding. Supervision units shall not engage in unfair competition. The bid-winning supervision unit shall file with the municipal construction administrative department in accordance with the relevant provisions. Fifteenth construction units and supervision units shall sign a supervision contract according to law, and report to the construction administrative department for the record.

In the construction supervision contract, the construction unit shall entrust the supervision unit to exercise the following rights:

(a) The right to issue supervision instructions such as commencement, shutdown, resumption of work and rework;

(two) have the right to review the design drawings, documents and construction drawings;

(three) the right to inspect and veto the quality of engineering construction;

(four) the right to sign the progress of the project;

(five) the right to sign and recognize the payment of the project price;

(six) the right to supervise the safety construction and environmental protection;

(seven) to replace the unqualified person in charge of the construction unit;

(eight) other rights stipulated by the state.

After signing the supervision contract, the construction unit shall promptly notify the construction unit in writing of the contents of the contract.
