Measures for the Implementation of People's Republic of China (PRC) Emergency Response Law in Hunan Province

Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Emergency Response Law of People's Republic of China (PRC) and the actual situation of this province. Article 2 These Measures shall apply to emergency prevention and emergency preparedness, monitoring and early warning, emergency response and rescue, post-disaster recovery and reconstruction within the administrative area of this province.

The term "emergencies" as mentioned in these Measures refers to natural disasters, accidents, public health incidents and social security incidents that suddenly occur and cause or may cause serious social harm and need to take emergency measures to deal with them. Article 3 Emergency response should be people-oriented, prevention first and scientific.

Emergency response to the implementation of administrative leadership responsibility system and accountability system, into the government performance evaluation. Article 4 The people's governments at or above the county level are the administrative leading organs to deal with emergencies, and should scientifically formulate plans for the construction of emergency response system in their respective administrative areas, incorporate them into the plans for national economic and social development, formulate corresponding policies and measures, and strengthen leadership, supervision and inspection of emergency response work in their respective administrative areas.

The relevant departments of the people's governments at or above the county level shall, according to the laws, regulations, rules, emergency plans and the responsibilities determined by the people's governments at the corresponding levels, guide and assist the people's governments at lower levels and their departments at the corresponding levels to do a good job in dealing with related emergencies.

Township people's governments and sub-district offices shall do a good job in responding to emergencies in their respective jurisdictions according to law.

The village (neighborhood) committee shall cooperate with the people's government to deal with emergencies. Article 5 The people's government at or above the county level shall set up an emergency committee (emergency command organization) composed of the heads of the people's government at the corresponding level and relevant departments, the local military organs at the same level and the relevant heads of the local China People's Liberation Army and the Chinese People's Armed Police Force, with the principal head of the people's government at the corresponding level as the director, to lead and coordinate the emergency work in their respective administrative areas in a unified way.

The people's governments at or above the county level shall, according to the actual needs, set up special emergency command institutions for emergencies such as flood control and drought relief, production safety, public health incidents and mass incidents, and designate the person in charge as the commander or director to organize, coordinate and direct the emergency response work of related categories. Article 6 The emergency management office of the people's government at or above the county level shall be responsible for the daily work of the emergency command organization of the people's government at the corresponding level, and perform the duties of emergency duty, information summary and analysis, comprehensive coordination, supervision and guidance.

The relevant departments of the people's governments at or above the county level, such as civil affairs, production safety supervision and management, health, public security, township people's governments, sub-district offices, etc., shall determine the corresponding institutions or staff to do a good job in emergency handling. Seventh people's governments at or above the county level shall incorporate the emergency response funds into the fiscal budget. Eighth people's governments at or above the county level shall establish a professional talent pool for emergency response, and employ relevant experts to form an expert group to provide analysis and evaluation, decision-making consultation and disposal suggestions for emergency response.

The people's governments at or above the county level and their relevant departments shall listen to the opinions of relevant experts when making administrative emergency decisions and taking emergency measures. Article 9 The people's governments at or above the county level and their civil affairs, production safety supervision and management, health, public security and other relevant departments shall evaluate the emergency response of the previous year before the end of March each year, analyze the development trend of emergencies this year, and put forward countermeasures for doing a good job in emergency response. Article 10 The people's governments at or above the county level shall establish an emergency linkage mechanism with the relevant departments and units of the people's governments at higher levels, the local China People's Liberation Army and the Chinese People's Armed Police Force, strengthen regional cooperation with the surrounding areas, and coordinate major issues in emergency response. Eleventh trade unions, the Communist Youth League, women's federations, charitable organizations, the Red Cross and other social organizations shall organize and guide social forces to carry out emergency services and assist the people's government to deal with emergencies.

Citizens, legal persons and other organizations have the obligation to participate in emergency response. Legal persons and other organizations shall, under the leadership of the people's government, do a good job in dealing with emergencies. Twelfth units and individuals that have made outstanding contributions to the emergency response work shall be commended and rewarded by the people's governments at or above the county level or the relevant departments; Casualties in emergency treatment, in accordance with the relevant provisions of the pension. Chapter II Prevention and Emergency Preparedness Article 13 The people's governments at or above the county level shall formulate overall emergency plans and organize the formulation of special emergency plans, and the relevant departments shall formulate emergency plans for emergency departments.

Township people's governments and sub-district offices shall formulate emergency plans according to actual conditions.

Encourage village (neighborhood) committees to formulate corresponding emergency plans according to actual conditions. Fourteenth the following units shall formulate specific emergency plans:

(a) mining (mineral processing), smelting enterprises, construction units;

(2) Units that produce, manage, store, transport and use inflammable and explosive materials, dangerous chemicals, radioactive materials and other dangerous goods;

(three) the operation and management units of water supply (drainage), power generation (supply), oil supply, gas supply, transportation, communication, radio and television, rivers, reservoirs, dams and other public facilities;

(4) Management units in public places such as schools, kindergartens, libraries, hospitals, financial and securities trading places, stations, airports, ports, docks, stadiums (gymnasiums), commercial (city) venues, theaters, places of leisure and entertainment, hotels, restaurants, parks and tourist attractions (spots);

(five) the management unit of public transportation;

(6) Organizers of large-scale mass activities;

(seven) large and medium-sized enterprises other than the provisions of the preceding six;

(eight) other units as prescribed by laws and regulations.
