Measures of Wuxi Municipality on Supervision and Inspection of Grain and Oil Circulation

Chapter I General Provisions Article 1 In order to standardize the supervision and administration of grain and oil circulation, maintain the order of grain and oil circulation, ensure the safety of grain and oil, and safeguard the legitimate rights and interests of producers, operators and consumers of grain and oil, these measures are formulated in accordance with the State Council's Regulations on the Administration of Grain Circulation and Wuxi's Regulations on the Supervision and Administration of Grain and Oil Safety, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the supervision and inspection of business activities such as purchasing, selling, storing, transporting and processing grain and oil within the administrative area of this Municipality (hereinafter referred to as grain and oil business activities). Article 3 The term "grain and oil" as mentioned in these Measures refers to wheat, rice, corn, miscellaneous grains and their finished grains, soybeans, oilseeds and edible vegetable oils. Article 4 The municipal administrative department of grain shall be responsible for the supervision and inspection of grain and oil circulation in the whole city and business guidance. Municipal grain and oil administrative law enforcement and supervision detachment is entrusted by the municipal grain administrative department to be responsible for the supervision and inspection of grain and oil circulation in the city.

Suburban branches of city (county), Xishan District, Huishan District grain administrative departments and municipal grain administrative departments are responsible for the supervision and inspection of grain and oil circulation within their respective jurisdictions or entrusted management, and perform the tasks of grain and oil circulation supervision and inspection issued by the municipal grain administrative departments.

Industry and commerce, quality and technical supervision, food and drug supervision, health, price and other departments are responsible for the supervision and inspection of grain and oil circulation within the scope of their respective duties. Fifth grain and oil operators' trade associations should give full play to the role of industry self-discipline, establish and improve industry norms, and assist in the supervision and inspection of grain and oil circulation. Article 6 The administrative department of grain shall, jointly with the departments of industry and commerce, quality and technical supervision, food and drug supervision, health and price, and the trade associations of grain and oil operators, establish a coordination mechanism for grain and oil circulation supervision and inspection, and strengthen work cooperation and information exchange. Seventh any unit or individual has the right to report to the relevant departments in violation of the provisions of these measures. The relevant departments shall keep confidential the informants and deal with them in a timely manner according to law. Chapter II Contents of Supervision and Inspection Article 8 In the supervision and inspection of grain and oil circulation, the administrative department of grain and its supervisors and inspectors shall conduct the following supervision and inspection of legal persons, other economic organizations and individual industrial and commercial households engaged in grain and oil business activities (hereinafter referred to as grain and oil operators):

(a) whether the purchase of grain and oil is qualified for grain purchase, and whether the grain purchase license is legal and valid.

(two) whether the purchase of grain and oil uses the inspection instruments specified in the national purchase quality standards; Whether to implement the national grain and oil quality standards, and whether there is any phenomenon that harms the interests of farmers and other grain and oil producers.

(three) whether the grain and oil purchase money is paid to the grain and oil sellers in time, and whether it is entrusted by other organizations or individuals to withhold and pay taxes, handling fees and other funds; Whether to regularly report the relevant information such as the purchase quantity of grain and oil in accordance with the regulations.

(four) whether the storage facilities and equipment meet the requirements of the relevant standards and technical specifications for grain and oil storage; Whether the grain and oil are stored in accordance with the relevant provisions and technical requirements of the state, whether there are harmful substances mixed in the grain and oil that may pollute the grain and oil, whether there are chemicals prohibited by the state or excessive use of chemicals in storage; Whether the quality of grain and oil and the hygiene of raw grain in storage activities meet the relevant national standards and regulations.

(five) whether the laws and regulations on safe transportation are implemented in the transportation of grain and oil; Whether the transportation and loading and unloading tools of grain and oil meet the hygiene standards; Whether the grain and oil products are mixed with toxic and harmful substances.

(six) whether to entrust a qualified grain and oil quality inspection agency to identify the quality of aged grain that has exceeded the normal storage life; Whether there is a phenomenon that the aged grain is not delivered out of the warehouse according to the relevant provisions of the aged grain sales treatment.

(seven) whether the minimum and maximum inventory standards are implemented in the acquisition, processing and sales of grain and oil.

(eight) whether the purchase, sale, storage and processing of grain and oil are established in accordance with the provisions; Whether to submit the basic data and related materials of purchasing, selling and storing grain and oil to the local administrative department of grain in accordance with the regulations.

(nine) whether the relevant policies of the state are implemented in the policy grain purchase and sale activities such as the supply of commissary.

(ten) whether the grain and oil operators bear the corresponding obligations in accordance with the provisions of the grain emergency plan to ensure the needs of emergency work.

(eleven) other contents stipulated by laws, regulations and policies to be supervised and inspected by the administrative department of food.

The supervision and inspection of the purchase of soybeans, oilseeds and edible vegetable oils shall not apply to the contents specified in Item (1) of the preceding paragraph. Article 9 Where the basic data and related materials submitted by grain and oil operators involve commercial secrets, the administrative department of grain has the obligation to keep them confidential. Article 10 An institution undertaking the supervision and inspection of grain and oil quality shall obtain corresponding qualifications according to law and be designated by the state administrative department of grain. Chapter III Procedures for Supervision and Inspection Article 11 The supervision and inspection of grain and oil circulation may take the forms of daily inspection, regular inspection, special inspection, spot check and special investigation. Twelfth grain and oil circulation supervision and inspection in accordance with the following procedures:

(a) to determine the object, content and work plan of supervision and inspection.

(2) Organizing the implementation of supervision and inspection.

(three) found illegal acts, in accordance with the prescribed procedures in a timely manner to investigate and deal with, need to be handed over, promptly handed over to the relevant organs and departments.

(four) in violation of the laws, regulations, rules and policies of grain and oil circulation, grain and oil operators shall put forward opinions and suggestions according to law, and if it is necessary to be punished, it shall be submitted to the administrative department for a decision on punishment.

(five) to inform the inspected object of the results of supervision and inspection or to deal with opinions and suggestions, and if it is necessary to be punished, the punishment decision shall be implemented.

(six) put forward the supervision and inspection report including the name of the inspected object, the date of inspection, the reason for inspection, the project, the main problems found, and the handling opinions.

(seven) the supervision and inspection report and related information filing.

(eight) tracking the implementation of supervision opinions, suggestions and punishment decisions.
