Chapter I General Provisions Article 1 In order to strengthen the management of the engineering consulting industry, standardize the practice behavior, ensure the quality of engineering consulting services, promote the scientific decision-making and standardized implementation of investment, and give play to the key role of investment in optimizing the supply structure, According to the Opinions of the Central Committee of the State Council on Deepening the Reform of Investment and Financing System (Zhong Fa [20 16] 18) and the Measures for the Examination and Approval of Enterprise Investment Projects, Article 2, engineering consultation follows the principles of independence, impartiality and science, and comprehensively applies multidisciplinary knowledge, engineering practical experience, modern science and management methods to provide investors and government departments with opportunities in economic and social development and at home and abroad. Article 3 An engineering consulting unit refers to an enterprise or institution established in China with independent legal personality and engaged in engineering consulting business.

Engineering consulting units and their employees shall abide by national laws, regulations and policies, abide by industry norms and professional ethics, and actively participate in and accept industry self-discipline management. Article 4 The National Development and Reform Commission is responsible for guiding and standardizing the development of the national engineering consulting industry, formulating the practice rules and standards of engineering consulting units, and organizing the supervision and management of the practice activities of engineering consulting units and their personnel. Local development and reform departments at all levels are responsible for guiding and standardizing the development of engineering consulting industry within their respective administrative areas, and supervising and managing the practice of engineering consulting units and their personnel. Fifth development and reform departments at all levels shall provide policy and business guidance to engineering consulting industry associations and other industry organizations, and strengthen supervision according to law. Chapter II Management of Engineering Consulting Units Article 6 Engineering consulting units shall be subject to notification and filing management. The engineering consulting unit shall record the following information through the national online approval and supervision platform for investment projects (hereinafter referred to as the online platform):

(1) Basic information, including enterprise business license (certificate of legal person of public institution), on-the-job personnel and technical strength, years of engineering consulting business, contact information, etc. ;

(two) engaged in engineering consulting professional and service scope;

(three) professional and technical personnel in the professional field for the record;

(4) Brief introduction of the results of non-confidential consultation.

The engineering consulting unit shall ensure that the archived information is true, accurate and complete. If the filing information changes, the engineering consulting unit shall promptly inform it through the online platform.

The basic information of engineering consulting units is announced to the public by the National Development and Reform Commission through the network platform. Seventh engineering consulting business according to the following professional division:

(15) Light industry and textile industry;

(16) Building materials;

(17) architecture;

(eighteen) municipal public works;

(nineteen) ecological construction and environmental engineering;

(20) Hydrogeology, engineering investigation and geotechnical engineering;

(twenty-one) other (subject to the actual major). Eighth engineering consulting services include:

(1) Planning consultation: including the compilation of overall planning, special planning, regional planning and industry planning;

(2) Project consultation: including the preparation of project opportunity study, investment and financing planning, project proposal (pre-feasibility study), project feasibility study report, project application report and fund application report, government and social capital cooperation (PPP) project consultation, etc.

(3) Evaluation and consultation: evaluation of planning, project proposal, feasibility study report, project application report, fund application report, PPP project implementation plan and preliminary design, mid-term evaluation and post-evaluation of planning and project, audit of project budget and final accounts, and other professional and technical services required to perform investment management functions;

(4) Whole-process engineering consultation: adopting the combination of various service modes to continuously provide local or overall solutions and management services for project decision-making, implementation and operation. The qualifications related to engineering design, engineering cost and engineering supervision shall be determined by the relevant competent authorities in the State Council. Ninth engineering consulting units to conclude a service contract and carry out the corresponding consulting business, should be consistent with the professional and service scope for the record. Tenth engineering consulting units shall establish and improve the consulting quality management system, establish and implement the quality responsibility system for consulting results and the results document audit system. Eleventh engineering consulting units shall conclude a written contract with the client, stipulate the rights and obligations of all parties, and abide by them together.
