Regulations of Changchun Municipality on the Development and Management of Urban Real Estate (202 1 Revision)

Chapter I General Provisions Article 1 In order to strengthen the supervision and management of urban real estate development and operation activities, standardize real estate development and operation activities, safeguard the legitimate rights and interests of real estate owners, and ensure and promote the healthy development of the real estate industry, these Regulations are formulated in accordance with the relevant provisions of laws and regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the development, operation, supervision and management of real estate on state-owned land in urban areas of this Municipality.

The term "real estate development and operation" as mentioned in these Regulations refers to the behavior of real estate development enterprises (hereinafter referred to as development enterprises) to carry out infrastructure construction and housing construction on urban state-owned land, transfer real estate development projects or sell commercial housing. Third city housing security and real estate management department is responsible for the supervision and management of the city's real estate development and business activities.

Municipal development and reform, planning and natural resources, construction, ecological environment, market supervision and management, forestry and gardens, public security, civil air defense and other relevant departments shall, according to their respective responsibilities, do a good job in the management of real estate development and business activities according to law. Article 4 The development and operation of real estate shall follow the principle of integrating economic benefits, social benefits and environmental benefits, implement overall planning, rational layout, comprehensive development and supporting construction, pay attention to saving and rational use of land, protect and improve the ecological environment, highlight technological innovation, and develop and construct energy-saving and environment-friendly buildings. Article 5 The municipal housing security and housing management department shall establish and improve the supervision and management mechanism of real estate development and operation, implement the credit evaluation system of real estate development enterprises, strengthen the construction of information system of real estate market and the management of credit files of development enterprises, and regularly publish relevant information on the real estate market and the honest operation of development enterprises. Chapter II Real Estate Development Enterprises Article 6 Real estate development and operation shall be carried out by legally established enterprises with the qualification of real estate development enterprises (hereinafter referred to as the qualification of development enterprises), and no other unit or individual may carry out real estate development and operation activities.

Development enterprise qualification is divided into one, two, three, four and provisional qualification. Development enterprises shall undertake corresponding real estate development projects in accordance with the approved qualification grade.

The qualification grade of development enterprises shall be subject to grading examination and approval system. City housing security and housing management department is responsible for the examination and approval of the city's four-level and provisional qualifications and the preliminary examination of the two-level and three-level qualification upgrades. Article 7 The establishment of a development enterprise shall meet the following conditions in addition to those stipulated by relevant laws and administrative regulations:

(a) the registered capital of not less than10 million yuan;

(2) There shall be no less than 5 professional managers with professional titles in architecture, structure, finance, real estate and related economy (including 1 person with intermediate or above professional titles in architecture and structure); Two or more accountants; Real estate and related economic professionals);

(three) the person in charge of engineering technology has the corresponding professional intermediate title or above, and the person in charge of finance and statistics has the corresponding professional junior title or above.

The establishment of a foreign-invested development enterprise shall comply with the provisions of the laws and administrative regulations on foreign investment in addition to the provisions of the first paragraph of this article. Eighth development enterprises shall, within thirty days from the date of obtaining the business license, apply to the municipal housing security and housing management department for temporary qualification approval, and submit the following materials:

(a) the real estate development enterprise qualification declaration form and the corresponding electronic documents;

(2) A copy of the business license of the enterprise as a legal person;

(3) Identification certificates of the legal representative, chairman and shareholders of the enterprise;

(4) The employment documents, qualification certificates, identity cards, employment certificates and social insurance payment vouchers of the general manager of the enterprise and senior managers of engineering, finance, operation and statistics departments. Professional technical certificates, qualification certificates, identity cards, employment certificates and social insurance payment vouchers of professional and technical personnel in engineering, finance, economy and statistics. Article 9 A development enterprise applying for Grade IV qualification shall submit the following materials to the municipal housing security and housing management department in addition to the materials specified in Article 8 of these regulations:

(a) the original and photocopy of the temporary qualification certificate;

(2) The investment plan approval (filing) document of the developed project, the real estate ownership certificate (state-owned land use certificate), the construction land planning permit, the construction project planning permit, the construction permit and the pre-sale permit of commercial housing, and the construction project completion acceptance document organized by the construction unit;

(three) to fill in the completed and unfinished project manuals;

(four) the basic table of the statistical annual report of real estate development in recent three years;

(five) "residential quality guarantee" and "residential instructions" samples and implementation report. Tenth city housing security and real estate management departments shall put forward examination and approval opinions within fifteen working days from the date of accepting the application for Grade IV or provisional qualification of development enterprises, and issue corresponding qualification certificates if they meet the conditions; Do not meet the conditions, shall not be issued, and explain the reasons in writing.

Development enterprises applying for two or three-level qualification upgrading shall submit relevant materials to the municipal housing security and housing management department according to law. City housing security and real estate management departments from the date of accepting the application 15 working days, put forward preliminary opinions, submitted to the provincial housing and urban and rural construction departments.
