Chapter II Grades and Standards for Qualification Recognition

Article 4 The qualification grade standards of advertising enterprises in China shall be formulated by China Advertising Association and the Enterprise Qualification Accreditation Committee of China Advertising Association. China advertising enterprise qualification is divided into China first-class advertising enterprise, China second-class advertising enterprise and China third-class advertising enterprise.

Its standard is: 1. China's first-class advertising enterprises.

(1) The enterprise has been established for more than 3 years and adopted modern enterprise management system, and its net asset value has increased in recent 3 years.

(2) Its registered capital is not less than 2 million yuan.

(3) The advertising professional equipment has a net value of 6.5438+0.8 million yuan, and has a fixed business place.

(4) The annual operating income of advertising is not less than 8 million yuan, and tax shall be paid according to regulations.

(five) the main business operators and business department heads have college education and corresponding advertising business performance.

(six) more than 40 employees, of which more than 80% have college education or junior professional titles, or have obtained laws and regulations, self-discipline rules and professional knowledge training certificates organized by advertising associations in cities with separate plans and cities above the sub-provincial level. (1) The enterprise has been established for more than 3 years and adopted modern enterprise management system, and its net asset value has increased in recent 3 years.

(2) The registered capital is more than 6,543,800 yuan.

(3) The advertising professional equipment has a net value of more than 800,000 yuan and a fixed business place.

(4) The annual operating income of advertising is not less than 4 million yuan, and the tax shall be paid according to the regulations.

(five) the main business operators and business department heads have college education and corresponding advertising business performance.

(six) more than 70% of the staff have college education or junior titles, or have obtained laws and regulations, self-discipline rules and professional knowledge training certificates organized by advertising associations in cities with separate plans and cities above the sub-provincial level. Enterprises have a certain investment in talent training.

(7) Customers who have successfully served for 2 years have provided comprehensive agency services for more than 5 brands in the past 2 years, and 2 brands are successful cases.

Three advertising enterprises in China.

(1) The enterprise has been established for more than 2 years and adopted modern enterprise management system, and its net asset value has increased in the past 2 years.

(2) The registered capital is more than 500,000 yuan.

(3) The net value of advertising professional equipment is more than 400,000 yuan, and it has a fixed business place.

(4) The annual operating income of advertising is not less than 6.5438+0.5 million yuan, which shall be taxed according to regulations.

(five) the main business operators and business department heads have college education and corresponding advertising business performance.

(six) more than 60% of the staff have college education or junior professional titles, or have obtained laws and regulations, self-discipline rules and professional knowledge training certificates organized by advertising associations in cities with separate plans and sub-provincial cities. (7) Customers who have successfully served for 2 years have provided comprehensive agency services for more than 3 brands in the past 2 years, and 1 brand is a successful case.

(nine) the advertising works produced and published were shortlisted for the above awards in the appraisal at or above the sub-provincial level. (ten) enterprises have contributed to public service advertisements and public welfare undertakings, and have influence in this industry. Article 5 The accreditation committee adopts the quantitative index scoring method to accredit enterprises. Due to the different operating modes of enterprises, among the standards stipulated in Article 4, except Article 1-4, the score of Article 5-10 will be flexible to a certain extent to adapt to the characteristics of enterprises.

Chapter III Qualification Application and Identification

Article 6 An advertising enterprise may apply to the advertising association in the place where the enterprise is registered (if there is no advertising association in the place where it is registered, it may directly apply to the local or municipal advertising association), and the advertising associations at all levels shall put forward their opinions and report them to the enterprise qualification accreditation committee of the advertising association of the province, autonomous region or municipality directly under the Central Government. Enterprises registered in the State Administration for Industry and Commerce may directly apply to the China Advertising Association for first-class qualification; To apply for Grade II or III qualification, an application shall be made to the advertising association of the province, autonomous region or municipality directly under the Central Government where the enterprise operates.

Article 7 An advertising enterprise applying for a qualification grade shall provide the following materials to the qualification accreditation committee: an application form for the qualification of an advertising enterprise and relevant performance certification materials; 2. Business license of enterprise legal person and advertising business license; Third, the articles of association of the enterprise; Four, the legal representative of the enterprise and the person in charge of technology, finance and operation of the enterprise; Five, the annual inspection certificate of enterprise advertising business qualification; Six, the relevant financial statements of the enterprise last year audited by an accounting firm.

Article 8 An enterprise applying for qualification upgrading shall provide the original qualification certificate in addition to the materials listed in Article 7 of these Provisions.

Article 9 The qualification of advertising enterprises shall be recognized once every six months. The deadline for application in the first half of the year is May 3 1, and the deadline for application in the second half is May165438+1October 3 1. The first-class advertising enterprise qualification in China shall be submitted to the enterprise qualification accreditation committee of China Advertising Association for accreditation after preliminary examination. The accreditation of national second-and third-class advertising enterprises shall be authorized by the China Advertising Association to be recognized by the enterprise accreditation committees of advertising associations of all provinces, autonomous regions and municipalities directly under the Central Government, and shall be reported to the China Advertising Association for approval.

Article 10 The China Advertising Association will announce the qualified enterprises in the public media, and issue the China Advertising Enterprise Qualification Certificate and logo uniformly printed by the China Advertising Association. The expenses such as announcement and certificate mark shall be borne by the enterprise that has obtained the qualification grade. Eleventh "China advertising enterprise qualification certificate" is valid for two years. Enterprises must hold the original qualification certificate for more than one year before they can apply for a higher qualification.

Article 12 If an advertising enterprise applies for the promotion of qualification or qualification grade and commits one of the following acts within one year before the date of application, it shall not be recognized: 1. Being severely punished for violating the Advertising Law of People's Republic of China (PRC); Two, in accordance with the provisions of the state, the employees who need to hold certificates have not passed the training and examination, and have not obtained the certificate; Three, due to unfair competition, causing great influence in the industry; Fourth, the financial reputation of the enterprise is poor; Five, other acts in violation of laws and regulations.

Article 13 If an advertising enterprise cancels or closes its business for various reasons, it shall return its qualification certificate to the original issuing authority for cancellation.

Chapter IV Supervision and Administration

Fourteenth advertising associations at all levels shall supervise and manage the qualifications of advertising enterprises.

Article 15 If an enterprise that has obtained the Qualification Grade Certificate of China Advertising Enterprise commits any of the following acts, it shall be given a warning by the recognized department, and informed criticism shall be reduced to the penalty of canceling the qualification grade: 1. Concealing the real situation and practicing fraud when applying for the qualification certificate; Two, the occurrence of the circumstances listed in article twelfth of these measures.

Chapter V Supplementary Provisions

Article 16 The increase of net assets in Article 4 of these Interim Measures refers to the increase of the owners' rights and interests of an enterprise or the increase of the business scale (turnover and tax) of an enterprise. Advertising revenue refers to the total advertising revenue of an enterprise (that is, advertising turnover, except other income) minus the expenses paid to the media and other units (subject to tax).

Seventeenth provinces, autonomous regions and municipalities directly under the central government advertising associations may formulate detailed rules for the implementation of the qualification management of advertising enterprises in accordance with these Interim Measures.

Article 18 The China Advertising Association shall be responsible for the interpretation of these Interim Measures.

Nineteenth the Interim Measures shall come into force as of April 1 2003. 6. Taxes paid: all advertising-related taxes paid by enterprises.

7. Resume of main operators: refers to the main work experience of the chairman or general manager.

8. Senior professional titles of advertising practitioners: including senior professional titles assessed by personnel departments and visiting professors hired by universities (copies are required).

Nine, advertising professional papers published: refers to the practitioners in the national well-known publications or publications published by provincial and municipal advertising associations advertising related papers.

10. Successfully serving customers for two consecutive years: it is necessary to provide customers with proof of "continuous satisfaction" with the service of the enterprise.
