Does our company go bankrupt when it is fully invested by another company? Should the labor contract be changed?

According to the provisions of Article 33 of the Labor Contract Law, the original labor contract will remain valid without modification, and new investors, managers and laborers will continue to perform it.

Legal basis: Article 33 of the Labor Contract Law changes the name, legal representative, principal responsible person or investor of the employing unit, without affecting the performance of the labor contract.

Article 34 Where an employing unit is merged or divided, the original labor contract shall remain valid, and the employing unit that inherits its rights and obligations shall continue to perform it.
