Self-discipline Convention of the National Fireworks and Firecrackers Industry Association (adopted by the Development Forum of the National Fireworks and Firecrackers Industry Association on July 6, 2005 at 5438+03)
Chapter I General Provisions
Article 1 In order to create a fair competitive market environment, protect the legitimate rights and interests of the production, operation and consumers of fireworks and firecrackers, and promote the healthy and orderly development of China's fireworks and firecrackers industry, this Convention is formulated in accordance with relevant national policies and regulations and the actual situation of the industry.
Article 2 This Convention regulates and constrains the behavior of the industry by establishing the self-discipline and guidance mechanism of the industry, so as to realize the independent operation and coordinated development of the industry.
Article 3 All organizations and individuals engaged in the production, operation and management of fireworks and firecrackers that recognize and join this Convention shall consciously abide by this Convention, and any violation can be resolved through coordination within the framework of this Convention.
Chapter II Professional Ethics
Article 4 Abide by social morality and professional ethics, safeguard the interests of the industry and promote the healthy, orderly and scientific development of the fireworks and firecrackers industry.
Article 5 Abide by the laws, regulations and relevant provisions of the state on production safety, adhere to the principle of "safety first, prevention first", strengthen the management of production safety and ensure the safety of people's lives and property.
Article 6 Maintain industrial policies and promote scientific and technological progress and technological innovation; Improve the mode of production and operation, reduce production and operation costs, improve safety management measures, and promote the modernization of production and circulation.
Seventh business according to law, integrity management, quality service; Advocate mutual respect and mutually beneficial cooperation among enterprises, and actively carry out bilateral or multilateral alliances; Effectively maintain the reputation of the industry and establish a good corporate and industry image.
Eighth encourage and support enterprises to carry out legal, orderly and fair competition, and oppose and resist any unfair competition.
Chapter III Trade Behavior
Ninth in accordance with the provisions of the state on safe production, management, storage, transportation and discharge, to obtain the corresponding business qualifications.
Tenth in the production and operation, encourage moderate concentration, scientific planning, fixed-point orientation, unified identification, chain operation, price tag, is conducive to safety management, economic operation and reasonable competition.
Article 11 The following acts of unfair competition shall not be carried out:
1. Exaggerate and publicize this enterprise or product through the media or other means; Spreading false information or black-box operation, damaging the image of competitors' enterprises or products;
2. Obtaining the right to produce and sell by bribery or other means; ?
3. Disrupting the normal market order by means of inferior low price, substantial price reduction on the basis of public quotation, lower than cost price and lowest protective price;
4. Excessive exercise of the authority of "unified centralized management"; ?
5. Excessive exercise of "territorial jurisdiction" authority; ?
6. Use other people's intellectual property rights and trade secrets to seek illegitimate interests.
Chapter IV Supervision and Administration
Twelfth rely on the government and relevant departments, give full play to the role of trade associations, create a market supervision system conducive to the combination of policies and regulations, industry self-discipline, public opinion supervision and mass participation, and maintain and improve market order.
Thirteenth fireworks association should be based on the principle of "self-restraint, democratic consultation, mutual supervision and coordination", strengthen the protection of the rights and interests of members and parties to the convention and supervise their behavior.
Article 14 The professional committee of firecrackers and fireworks of China Daily Miscellaneous Goods Circulation Association, local associations and contractors have the obligation to vigorously publicize this Convention and consciously abide by and ensure its implementation.
Article 15 When the rights and interests of the parties to this Convention are infringed by other non-parties, they may appeal to the Fireworks and Firecrackers Professional Committee of China Daily Miscellaneous Goods Circulation Association and local associations for help. The requested party has the obligation to help coordination through active work.
Article 16 Enterprises and individuals engaged in the production and operation of fireworks and firecrackers that are not parties to this Convention may seek help and guidance from the Fireworks and Firecrackers Professional Committee of China Daily Miscellaneous Goods Circulation Association and local associations for problems arising from the implementation of this Convention, but they are not protected and restricted by this Convention when dealing with these problems.
Article 17 The contractor shall consciously accept the supervision and criticism from all walks of life in the industry, and resist and correct unhealthy practices in the industry.
Article 18 In order to ensure the effective implementation of this Convention, the Self-discipline Coordination Steering Group of the National Fireworks and Firecrackers Industry Association shall be recommended by the Self-discipline Conference of the National Fireworks and Firecrackers Industry Association, and the Coordination Steering Group shall conduct investigation and study on major industry issues within the scope of this Convention and put forward commendation or coordination opinions, and conduct annual inspection and summary on the implementation of the Convention.
Chapter V Reward and Punishment
Nineteenth units and individuals that have exemplary compliance with national policies and regulations and this Convention shall be commended every year and notified in the industry. Specifically, it can be awarded honorary titles such as honest management, safety management and scientific and technological innovation, and publicized through the media.
Twentieth units and individuals who violate the national policies and regulations and this Convention shall, according to the seriousness of the case, take measures such as criticism, internal notification and public exposure. And ask them to stop the breach of contract, condemn the industry in time and publicize it through the media. If there are serious violations against contractors and individuals, their right to participate in the convention should be revoked, and the relevant departments should be suggested to revoke their qualifications.
Chapter VI Supplementary Provisions
Article 21 The self-discipline meeting of the National Fireworks Industry Association is the highest authority of this Convention and is held once a year. The Firecracker and Fireworks Professional Committee of China Daily Miscellaneous Goods Circulation Association is the executive body of this Convention, and is responsible for the organization and implementation of this Convention and the convening of relevant meetings.
Twenty-second members of this convention have the right to supervise and make suggestions on the legality and fairness of the implementation of this convention by the convention implementing agencies.
Article 23 This Convention shall come into force after being signed by the legal representative of the organizer of the Convention or its entrusted representative, and shall be announced to the public by the implementing agency of the Convention within 30 days after its entry into force.
Article 24 During the entry into force of this Convention, this Convention may be amended upon the proposal of more than one tenth of the member units of this Convention and with the consent of more than two thirds of the member units.
Twenty-fifth domestic units and individuals engaged in the production, management and scientific research of fireworks and firecrackers industry, who consciously accept the self-discipline rules of this Convention, may apply to join this Convention and become a full member unit with the consent of more than two-thirds of the member units of the National Fireworks and Firecrackers Industry Self-discipline Conference; The member units of this Convention have the freedom to withdraw from this Convention, and the application shall come into effect after being voted by the National Fireworks Industry Self-discipline Conference.
Article 26 This Convention shall be interpreted by the Fireworks and Firecrackers Professional Committee of China Daily Miscellaneous Goods Circulation Association.
Article 27 If this Convention is inconsistent with the national policies and regulations, the national policies and regulations shall prevail.
