Will the insurance company pay for the property losses suffered in the earthquake?

If you are insured against natural disasters, the insurance company will compensate you for the property losses suffered in the earthquake.

Because the earthquake is also a kind of risk, in life insurance, the insurance company will pay for the casualties caused by the earthquake, because the earthquake can not exempt life insurance from liability, so it will pay. In the basic property insurance, the earthquake is exempt, so the insurance company will not compensate for the losses caused by the earthquake. However, in some special insurances, with the consent of the parties through consultation, the earthquake can be covered as the insurance coverage, and the insurance company will compensate for the losses caused. However, insurance companies will underwrite by raising insurance rates and other conditions. Under normal circumstances, insurance companies will not be liable for the losses caused by earthquakes.

Firstly, analyze personal insurance.

According to Article 12 of the Insurance Law, life insurance is insurance with life and body as the subject matter. In layman's terms, it is to protect people. At present, almost all domestic insurance pays this responsibility. There are mainly the following categories: accident insurance, critical illness insurance and life insurance.

Accident insurance: the insured is injured in the earthquake, and the medical expenses incurred are claimed by medical invoices or social security statements. Insurance companies pay according to the principle of compensation, that is, the amount of medical expenses paid by insurance companies does not exceed the actual medical expenses paid by individuals. If there is hospitalization allowance, it shall be paid according to the actual hospitalization days agreed in the contract (pay attention to whether there are any compensation days and annual hospitalization days restrictions). If it causes disability, it shall be appraised according to the responsibilities agreed in the terms and conditions, and the corresponding disability insurance money shall be paid. In case of accidental death, pay the death insurance directly.

Critical illness insurance: if a major accident occurs, it may lead to some serious illness insurance liabilities, such as deep coma, severe craniocerebral injury, paralysis, limb loss, blindness and deafness caused by the accident. These serious illness responsibilities are paid according to the insured amount, and it is only necessary to provide corresponding medical records, diagnosis certificates, inspection reports, surgical records and other relevant medical records that can prove the accident, or appraisal reports.

Life insurance: if you are killed in an earthquake, you will pay the beneficiary according to the insured amount agreed in the contract. Pay special attention to the distribution of beneficiaries here.

In the earthquake disaster, it is likely that designated inheritance and legal inheritance will coexist, which involves the application of insurance law and inheritance law.

Secondly, look at property insurance.

According to Article 12 of the Insurance Law, property insurance is insurance with property and its related interests as the subject matter. In layman's terms, it is to protect things. Property lost in an earthquake, especially personal property such as houses and cars, is usually not compensated. Property insurance usually does not cover the liability caused by earthquakes and tsunamis and their secondary disasters.

At present, China has not insured the auto insurance losses caused by the earthquake and its secondary disasters as a special agreed liability. Buildings and other building facilities can be insured through special agreements.
