Can trade associations set up companies or become shareholders?

As a mass organization, trade associations can set up companies or participate in other companies. But you can't participate in business activities in the name of your own organization.

The role of trade associations: As an assistant of the government, trade associations can only rely on the administrative department to engage in activities to exercise the government's function of managing economic affairs within a certain scope. Some trade associations only collect membership fees and do not provide services for member enterprises, becoming the "second government" of enterprises, losing the true nature of trade associations, resulting in the inability of trade associations to play their due functions.

Trade association refers to a social intermediary organization that serves, consults, communicates, supervises, is fair, self-disciplined and coordinated between the government, enterprises and commodity producers and operators. Trade association is a kind of non-governmental organization, which does not belong to the series of government management institutions, but a bridge and link between the government and enterprises. Trade association belongs to the enterprise legal person stipulated in China's civil law, and it is a kind of non-governmental organizations and social groups in China, that is, internationally renowned non-governmental organizations (also known as NGOs), which are non-profit organizations.

Autonomy is the most essential feature of trade associations. Trade associations, like other autonomous organizations, once established according to law, can act independently within the legal scope to achieve the specific purpose of establishing the organization. The autonomy of self-organization and self-management of trade associations is the right that trade associations must enjoy if they can exist independently. Autonomy mainly includes the right to manage autonomous affairs, the right to organize personnel and the right to use funds.

The decoupling of trade associations and chambers of commerce from administrative organs is a reform task that has been determined by relevant departments. The content of decoupling is mainly separated from administrative organs in functions, institutions, property, personnel, foreign affairs and party building.

In the implementation of this reform task, in June, 20 15, the State Council, China, issued the overall plan for decoupling the chamber of commerce of trade associations from the administrative organs, which clarified the basic principles, main tasks, relevant policies, methods and steps of decoupling, and served as our action guide for decoupling.

At present and in the future, the Ministry of Civil Affairs, as the registration management department of social organizations, should first do the first batch of decoupling pilot work of the national industry chambers of commerce under the overall planning and coordination guidance of the joint working group. Previously, according to the mobilization and declaration of various business departments, 148 companies have been identified as the first batch of decoupling pilot units, and now 25 department heads 6 1 industry association decoupling pilot schemes have been approved.
