If the employer fails to pay wages, the laborer may apply to the people's court for a payment order; If the employer is in arrears with wages, the employee may complain to the labor administrative department.
Legal basis: Article 30 of People's Republic of China (PRC) Labor Contract Law. If the employer is in arrears or fails to pay the labor remuneration in full, the employee may apply to the local people's court for a payment order according to law, and the people's court shall issue a payment order according to law.
The procedure of payment order, that is, the supervision procedure, refers to the procedure that the court urges the employer to perform the debt within a time limit by means of payment order according to the application of the laborer.
If the employer fails to raise a written objection or the objection is rejected within 15 days after receiving the payment order, the payment order will take effect and have the force of enforcement, and the employee has the right to apply to the court that issued the payment order for enforcement.
