What should the company do if it runs away in arrears?

Legal analysis: 1. To collect useful evidence, workers must keep good evidence, especially the evidence that proves that they have a factual labor relationship with the unit: recruitment brochures, records, roster of labor contract workers, attendance records, job cards, work permits (cards), passes, meal tickets, overtime records, certificates of deposit, unpaid wages, testimony of colleagues, etc. 2. Protect the company's means of production,

As soon as workers know that the boss is running away, they must protect the equipment and other related means of production in the factory and wait for the government department to seal it up. Don't be taken away by the boss secretly. The boss can't get it back. Then the proceeds from the auction of these equipment will be used to pay the arrears of wages. 3. Complain or arbitrate to the labor inspection brigade. In case of unpaid wages, you should complain to the labor inspection department as soon as possible or prepare evidence to apply to the labor dispute arbitration committee for labor arbitration.

If the employer fails to pay the labor remuneration in full and on time, the labor administrative department may order the employer to pay within a time limit, and order the employer to pay compensation to the employee according to the standard of more than 50% 100% of the payable amount. In some cases, the company's unpaid wages may also violate the criminal law and constitute a crime of refusing to pay labor remuneration.

Legal basis: Article 276 of the Criminal Law of People's Republic of China (PRC) evaded the payment of laborers' labor remuneration by transferring property or concealing. Or if the amount of unpaid labor remuneration is relatively large, and the employee still fails to pay after being ordered by the relevant government departments to make corrections, he shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, fixed-term imprisonment of not less than three years but not more than seven years and shall also be fined.

If a unit commits the crime mentioned in the preceding paragraph, it shall be fined, and the directly responsible person in charge and other directly responsible personnel shall be punished in accordance with the provisions of the preceding paragraph.

Whoever commits the acts mentioned in the preceding two paragraphs, but has not caused serious consequences, pays the laborer labor remuneration before bringing a public prosecution, and bears the corresponding liability for compensation according to law, may be mitigated or exempted from punishment.
