Can equity be mortgaged?

Legal analysis: as a right, equity can not be mortgaged, but it can be pledged. Because only movable and immovable property can be mortgaged. Non-listed companies that pledge their shares need to register with the industrial and commercial departments. Without filing and registration, the pledge established on the equity will not be established.

Legal basis: Article 445 of the Civil Code of People's Republic of China (PRC) pledges accounts receivable, and the pledge right is established at the time of pledge registration. Accounts receivable shall not be transferred after pledge, except that the pledgor and pledgee agree through consultation. The pledgor shall pay off the debts in advance to the pledgee or deposit the proceeds from the transfer of accounts receivable.
