The establishment of enterprises as stipulated in the examination and approval management of general aviation enterprises

Article 7 To establish a general aviation enterprise, the following basic conditions shall be met:

(a) the legal representative of the enterprise is a citizen of China;

(two) the main person in charge of the enterprise shall have the corresponding aviation professional knowledge. The person in charge of flight and operation technology and quality should not only have the corresponding aviation professional knowledge, but also work in the aviation department or professional field for more than three years, and have certain organizational management experience;

(3) The registered capital of enterprises engaged in Class A general aviation projects is not less than 20 million yuan, of which the registered capital of enterprises engaged in business flight projects is not less than 50 million yuan; Enterprises operating Class B general aviation projects have a registered capital of not less than 6,543,800,000 yuan; The registered capital of an enterprise engaged in Class C general aviation projects shall not be less than 5 million yuan. The minimum registered capital of foreign-invested general aviation enterprises shall be determined by CAAC;

(four) there are more than two civil aircraft registered in People's Republic of China (PRC) and meeting the airworthiness standards;

(5) There are aircrew members who are suitable for civil aircraft, have received professional training and obtained licenses, and have the required conditions, and the ratio of civil aircraft to aircrew members shall be above 1: 1.5 (inclusive);

(6) There are maintenance, operation technology, dispatching, communication and other service support personnel who are suitable for the civil aircraft and meet the standards and have obtained licenses or certificates;

(7) Having a base airport suitable for civil aircraft and its corresponding infrastructure;

(eight) the maintenance conditions of the civil aircraft used and other facilities and equipment that can ensure flight safety and adapt to the operation quality of the declared business projects;

(9) Other conditions deemed necessary by CAAC.

Article 8 When a general aviation enterprise applies for the preparation of Class A business projects, the local regional civil aviation administration shall put forward preliminary examination opinions and report them to the General Administration of Civil Aviation for approval.

General aviation enterprises applying for the preparation of Class B business projects shall be examined and approved by the local regional civil aviation administration and reported to the General Administration of Civil Aviation for the record. Among them, the general aviation enterprises planning and constructing Class B business projects across the jurisdiction of the regional civil aviation administration shall be examined and approved by the Civil Aviation Administration of China.

General aviation enterprises applying for the preparation of Class C business projects shall be examined and approved by the local regional civil aviation administration and reported to the General Administration of Civil Aviation for the record. Among them, general aviation enterprises that plan and construct Class C business projects across the jurisdiction of regional civil aviation administrations shall be examined and approved by the local regional civil aviation administrations, but the consent of other relevant regional civil aviation administrations shall be obtained.

Article 9 To apply for the establishment of a general aviation enterprise, the applicant shall first understand the development of national general aviation, the relevant policies and regulations for the establishment of a general aviation enterprise, and the specific procedures and requirements for applying for the establishment of a general aviation enterprise.

Article 10 After investigation, research and demonstration, the applicant applies for the establishment of a general aviation enterprise with Class B and Class C business projects, and reports it to the people's government of a prefecture-level city or its national competent department for approval; General aviation enterprises applying for the construction of Class A business projects shall report to the people's governments of provinces, autonomous regions and municipalities directly under the Central Government or the competent departments of their countries for approval.

Article 11 To apply for the establishment of a general aviation enterprise, the following documents shall be submitted:

(1) An application report for preparation;

(2) the approval document of the local people's government or the competent department of the country where the applicant is located;

(3) A feasibility study report on the establishment of a general aviation enterprise, including:

1. General aviation market demand in this region and the necessity of establishing general aviation enterprises;

2. The feasibility of the project to be operated and the corresponding facilities and equipment such as the model, business area and base airport;

3. Sources and training channels of aircrew, maintenance personnel, flight dispatch, communication and navigation, business management and other service support personnel;

4. Reliability of operation technology quality assurance;

5. Forecast and analysis of economic benefits;

(4) A capital verification certificate issued by a legally qualified capital verification institution;

(5) The post approval document and qualification list of the person in charge of the preparatory establishment, and an assessment of whether the person has the organizational ability to establish a general aviation enterprise; The qualification list of the person in charge of flight and operation technology and quality and the evaluation of organization and leadership ability;

(6) Where two or more companies invest in the establishment of a general aviation enterprise, they shall provide the agreements and contracts signed by the shareholders. If the investor is an enterprise, a copy of the business license shall also be provided;

(seven) other documents that need to be provided.

Article 12 Any general aviation enterprise applying for the establishment of Class B and Class C business projects shall submit the above documents and materials in eight copies to the local regional civil aviation administration. To apply for the establishment of a general aviation enterprise with Class A business projects, the above documents shall be submitted in eight copies to the local regional civil aviation administration, and submitted to the General Administration of Civil Aviation after the preliminary examination by the regional civil aviation administration.

Article 13 The General Administration of Civil Aviation and the Regional Administration of Civil Aviation shall, after receiving the applicant's application for preparation, review it according to the basic conditions and relevant policies and regulations for the establishment of a general aviation enterprise, and give the applicant a reply on whether to approve the preparation within 90 days.

Article 14 During the preparation of a general aviation enterprise, the applicant must strictly abide by the relevant national laws, administrative regulations and civil aviation rules, and carry out the following work according to the approval documents of the General Administration of Civil Aviation or the regional civil aviation administration:

(1) Handling the declaration procedures for purchasing civil aircraft;

(two) to apply for civil aircraft nationality registration certificate, airworthiness certificate, maintenance license, maintenance personnel license and general aviation enterprise logo;

(three) to apply for the aircrew medical certificate, aircrew license and flight dispatcher license;

(4) Applying for ground and airborne radio station licenses;

(five) to apply for the airport use permit of the self-built base airport or to sign an airport road protection agreement with the airport used;

(six) the communication, meteorology and navigation information service guarantee agreement signed with the relevant units and the letter of intent to entrust the flight dispatch agent;

(seven) according to the relevant provisions of the General Administration of Civil Aviation and the Regional Administration of Civil Aviation, the following manuals suitable for the actual situation of enterprises are formulated:

1. Enterprise Operation Manual;

2. Enterprise quality manual;

3. Flight Dispatching Manual;

4. Civil aircraft minimum equipment list;

5. Quick list;

6 civil aircraft maintenance engineering manual and maintenance planning;

7. General aviation flight work manual:

8 airport runway support manual;

9. Aviation safety management manual;

10. security scheme;

1 1. Other necessary documents and manuals.

Fifteenth after the completion of the preparatory work, the applicant shall apply to the General Administration of Civil Aviation or the Regional Administration of Civil Aviation for a general aviation enterprise business license (hereinafter referred to as the business license).

Article 16 To apply for a business license, the applicant shall submit the following documents:

(1) An application for establishing a general aviation enterprise;

(2) A copy of the notice of pre-approval of enterprise name, enterprise logo and approval document of CAAC issued by the administrative department for industry and commerce where the enterprise is located;

(3) Articles of association of the enterprise;

(four) the approval documents to approve the purchase of machinery;

(5) Civil aircraft nationality registration certificate, airworthiness certificate, maintenance permit and approved maintenance plan;

(6) ground and airborne radio station licenses;

(seven) the registration form of the technical status of the aircrew, the crew and the flight dispatcher and the valid proof of the physical examination of the flight personnel in that year;

(eight) the airport use license of the self-built base airport or the airport road protection agreement signed with the airport;

(nine) the legal representative of the enterprise and the person in charge of flight and operation technology and quality, and their qualifications and identity certificates;

(10) A capital verification certificate issued by a legally qualified capital verification institution;

(11) In the case of a limited liability company or a joint stock limited company, documents indicating the names and residences of the company's directors, supervisors and managers, as well as certificates of appointment, election or employment;

(twelve) proof that the enterprise has insured the ground third party liability insurance;

(13) approved or recognized enterprise operation manual, enterprise quality manual, flight manual, quick check list, flight dispatch manual, civil aircraft minimum equipment list, civil aircraft maintenance engineering manual, general aviation flight work manual, airport runway support work manual, aviation safety management manual and safety guarantee scheme.

Article 17 After reviewing the application report, materials, license and preparation of the applicant, CAAC or CAAC will issue a business license to those who meet the requirements for issuing a business license.

A general aviation enterprise shall apply to the local regional administration for managing official aircraft for other units or individuals and engaging in official flight business for the personal use of the managed units or individuals, and report to the Civil Aviation Administration for examination and approval after being approved by the regional administration.

Article 18 An applicant shall apply for registration with the local administrative department for industry and commerce with the business license issued by CAAC or CAAC Regional Administration, and can start business activities only after obtaining the business license of enterprise as a legal person, and send a copy of the license to CAAC and CAAC Regional Administration for the record.

Nineteenth from the date of approval of the preparation of the business license within two years, cancel the qualification.

If the qualification for preparation is lost, CAAC or CAAC will no longer accept the application of the original applicant within two years.

Article 20 Without approval, a general aviation enterprise shall not engage in business activities beyond the business scope stipulated in the business license.

Article 21 A general aviation enterprise engaged in general aviation business activities shall sign a written contract with the user.

Article 22 General aviation enterprises shall take effective measures to ensure flight safety, protect the environment and ecological balance, prevent damage to the environment, residents, crops or livestock, and provide good services to users in accordance with the safety, technical standards and operational quality requirements stipulated by the State and the General Administration of Civil Aviation.

Article 23 A general aviation enterprise shall, in accordance with the provisions, submit the information and statistical data of its safety production and operation to the General Administration of Civil Aviation and the Regional Administration of Civil Aviation.

Article 24 General aviation enterprises shall accept the supervision and management of the General Administration of Civil Aviation and the Regional Administration of Civil Aviation, and complete the emergency rescue and disaster relief tasks assigned by the state.
