Examination and approval procedures and time limit:

After receiving the application materials, the Municipal Administration of Work Safety shall review and conduct on-site verification of the materials submitted by the applicant. Validity: The business license is valid for 3 years. After the expiration of the term of validity, if the business unit continues to engage in the business activities of dangerous chemicals, it shall apply to the original license-issuing organ for renewal of the license within 3 months before the expiration of the business license, and apply for renewal of a new license after passing the examination.

Measures for the administration of business licenses for hazardous chemicals

Chapter I General Principles

Article 1 In order to strengthen the safety management of hazardous chemicals, standardize the business and sales activities of hazardous chemicals, and ensure the safety of people's lives and property, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on Safety in Production and the Regulations on Safety Management of Hazardous Chemicals.

Article 2 These Measures shall apply to the operation and sale of hazardous chemicals in People's Republic of China (PRC).

These Measures shall not apply to the business of civil explosives, radioactive substances, nuclear substances and town gas.

Article 3 The State practices a licensing system for the operation and sale of dangerous chemicals. Units engaged in the sale of hazardous chemicals shall obtain a business license for hazardous chemicals (hereinafter referred to as the business license) in accordance with these measures, and apply for registration with the administrative department for industry and commerce according to law with the business license. No unit or individual may engage in the sale of dangerous chemicals without obtaining a business license and industrial and commercial registration.

Article 4 Business licenses are divided into Class A and Class B. Units that have obtained Class A business licenses can sell highly toxic chemicals and other dangerous chemicals. Units that have obtained Class B business licenses can only operate and sell dangerous chemicals other than highly toxic chemicals.

The business license shall be approved and issued by the economic and trade departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government or the safety production supervision and management departments entrusted by them (hereinafter referred to as the provincial license-issuing organs); Class B business license shall be approved and issued by the supervision and management department of the Municipal People's Government responsible for the comprehensive work of hazardous chemicals safety (hereinafter referred to as www.qingdaocom.com, the municipal issuing authority). The refined oil business license is included in the management of Class A business license.

Article 5 state administration of work safety is responsible for the supervision and administration of the examination, approval and issuance of national business licenses.

Provincial license issuing agencies and municipal license issuing agencies are responsible for the supervision and management of business licenses within their respective administrative areas.

Chapter II Application and Approval of Business License

Article 6 A business and sales unit of hazardous chemicals (hereinafter referred to as the business unit) shall meet the following basic conditions:

(a) business, storage sites, facilities, buildings in line with national standards "Code for Fire Protection Design of Buildings" (GBJ 16), "Safety Regulations for Explosive Dangerous Places" and "Regulations on Fire Safety Management of Warehouse", and passed the acceptance by public security fire control institutions;

(2) The operating conditions and storage conditions meet the requirements of Operating Conditions and Technical Requirements for Hazardous Chemicals Trading Enterprises (GB 18265) and General Rules for Storage of Commonly Used Hazardous Chemicals (GB 15603);

(three) the main person in charge and the person in charge of the unit, the safety production management personnel and the business personnel have passed the professional training and examination, and obtained the post qualifications;

(four) a sound safety management system and post safety operation procedures;

(5) Having the emergency rescue plan of the unit.

Article 7 An entity applying for a business license independently chooses a qualified safety evaluation institution to conduct safety evaluation on its business conditions.

Article 8 A safety evaluation institution shall evaluate item by item whether the unit applying for business license meets the conditions as stipulated in Article 6 of these Measures, and issue a safety evaluation report.

Article 9 Units applying for Class A and Class B business licenses shall apply to the provincial and municipal license-issuing authorities respectively and submit the following materials:

(1) An application form for the business license of hazardous chemicals;

(2) Safety evaluation report;

(three) a copy of the fire safety acceptance documents of the buildings in the business and storage places;

(four) a copy of the ownership or lease certificate of the business and storage premises and facilities;

(five) a copy of the professional training certificate of the main person in charge and the person in charge of the unit, the safety production management personnel and the business personnel;

(six) safety management system and post safety operation procedures.

Article 10 The issuing authority shall, within 30 working days from the date of accepting the application, examine the materials submitted by the applicant, and issue a business license if it meets the requirements; If it does not meet the requirements, it shall notify the applicant in writing and explain the reasons.

Article 11 The business license shall specify the following items:

(a) the name of the business unit;

(2) The domicile (address and business premises) of the business unit;

(three) the name of the legal representative or the person in charge of the business unit;

(four) the economic type of the institution;

(5) Licensed business scope (the name of highly toxic chemicals shall be indicated, and other hazardous chemicals shall be indicated; The product name shall be marked on the refined oil);

(6) Date of issuance and validity period;

(7) certificate number.

Twelfth business units to rebuild, expand or relocate business and storage sites, expand the scope of business license, should apply for a new business license in advance.

Where a business unit changes its name, economic type or registered legal representative or person in charge, it shall, within 20 working days from the date of change, apply to the original license-issuing authority for the change procedures and renew its business license.

Article 13 The business license is valid for 3 years. After the expiration of the term of validity, if the business unit continues to engage in the business activities of dangerous chemicals, it shall apply to the original license-issuing organ for renewal of the license within 3 months before the expiration of the business license, and apply for renewal of a new license after passing the examination.

Article 14 The issuing authority shall promptly notify the public security and environmental protection departments at the same level of the issuance of business licenses.

Fifteenth business units shall not transfer, buy, sell, lease, lend, forge or alter the business license.

Chapter III Supervision and Administration of Business License

Article 16 The issuing authority shall adhere to the principles of openness, fairness and impartiality, and examine, approve and issue business licenses in strict accordance with the conditions and procedures stipulated by laws, regulations, rules and standards.

Seventeenth license issuing organs should strengthen the supervision and management of business licenses, establish and improve the management system of business license approval and issuance of files.

Eighteenth municipal license issuing organs shall report the approval and issuance of the annual business license of the administrative region to the provincial license issuing organs for the record. The provincial issuing authority shall report the examination and approval and issuance of the annual business license of its administrative region to the State Administration of Work Safety for the record.

Article 19 The issuing authority shall supervise and inspect the units that have obtained business licenses within their respective administrative areas. The business unit shall accept the supervision and inspection carried out by the issuing authority according to law, and shall not refuse or obstruct it without justifiable reasons.

Chapter IV Punishment

Twentieth without obtaining a business license, engaged in dangerous chemicals business without authorization, by the provincial license issuing authority or municipal license issuing authority in accordance with the provisions of Article 57 of the Regulations on the Safety Management of Dangerous Chemicals shall be punished.

Twenty-first business units in violation of the provisions of these measures, one of the following acts, the license issuing organ shall revoke the business license:

(1) Providing false documents or obtaining a business license by other deceptive means;

(two) no longer have the basic conditions for the sale of dangerous chemicals;

(3) Transferring, buying, selling, leasing, lending, forging or altering the business license.

Article 22 Any staff member of the issuing authority who engages in malpractices for personal gain, abuses his power, commits fraud or neglects his duty shall be given administrative sanctions of demotion or dismissal in accordance with the provisions of Article 55 of the Regulations on the Safety Management of Hazardous Chemicals; If a crime is constituted, criminal responsibility shall be investigated according to law.

Twenty-third institutions that undertake safety evaluation issue false evaluation reports, and the illegal income shall be confiscated by the safety production supervision and management departments at or above the provincial level, and a fine of 30 thousand yuan shall be imposed; If there is no illegal income, a fine of 20 thousand yuan shall be imposed; And suggest that the department that granted its qualification revoke its qualification certificate; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter V Supplementary Provisions

Twenty-fourth dangerous chemicals production units to sell dangerous chemicals produced by their own units, no longer apply for a business license, but to sell dangerous chemicals not produced by their own units or set up sales outlets outside the factory, they still need to apply for a business license.

Twenty-fifth units that have obtained business licenses before the implementation of these measures shall re-apply for business licenses within 6 months from the date of implementation of these measures. If it is not handled within the time limit, it shall not continue to operate and sell dangerous chemicals.

Article 26 The business license shall be uniformly printed by state administration of work safety.

Twenty-seventh of these measures authorize state administration of work safety to be responsible for the interpretation.
