The term "houses" as mentioned in these Regulations refers to buildings and structures such as houses on the land.
If the state and province have other provisions on the lease of state-owned houses and self-run residential houses, those provisions shall prevail. Article 3 The lease of houses shall abide by the provisions of laws and regulations, and follow the principles of voluntariness, fairness, honesty and credit, and equal compensation. Article 4 The real estate administrative department of the people's government at or above the county level is the competent authority for the management of house leasing (hereinafter referred to as the competent authority), which implements unified management of house leasing.
Land management, industry and commerce, taxation, prices, public security and other relevant departments shall, in accordance with their respective responsibilities, supervise and manage housing leasing according to law. Chapter II Lease Management Article 5 The lease of houses shall be subject to the registration system.
The lessor and the lessee shall sign a house lease contract and apply to the local competent department for registration within ten days from the date of signing the house lease contract. Article 6 To apply for registration of house lease, the lessor shall submit the following documents:
(a) housing ownership certificate or other legal proof of ownership;
(two) the applicant's identity card or legal qualification certificate.
Houses entrusted to others for escrow may be registered by the custodian. In addition to the documents specified in the preceding paragraph, the custodian shall also submit the entrustment certificate entrusted by the property owner.
* * * If a person who owns a house applies for registration, in addition to the documents specified in the first paragraph, he shall also submit proof that others agree to rent it. Article 7 The lessee shall submit the following documents when applying for the registration of house lease:
(a) if the lessee is an individual, submit a resident identity card;
(two) if the lessee is an overseas person, submit the residence certificate issued by the public security organ;
(3) If the lessee is an organ, enterprise, institution or other organization, the valid certificate of the relevant unit or organization shall be submitted. Article 8 For those who meet the conditions for housing lease registration, the competent authority shall register them within 10 days from the date of receiving the application for registration and issue a housing lease certificate.
The competent authority shall, within 30 days from the date of registration, copy the registration materials to the land management department, family planning department and tax department at the same level. Ninth houses under any of the following circumstances shall not be rented:
(a) the ownership of the house is controversial;
(two) there is no proof of housing ownership or other legal ownership;
(three) has been notified to be included in the scope of urban planning and demolition, ready for demolition;
(four) without the consent of the mortgagee, it has been mortgaged as an asset;
(5) Belonging to illegal construction;
(six) does not meet the housing safety standards, affecting the safety of use;
(seven) there are other circumstances that prohibit rental according to law. Tenth city and county price departments shall, jointly with the competent departments and other relevant departments, regularly publish the rental guidance for residential and non-residential housing according to the housing rental market price level. Eleventh for the purpose of making profits, renting houses built on state-owned land that has obtained the right to use by administrative allocation, and the land income included in the rent shall be turned over to the finance at the same level. Specific measures, according to the relevant provisions of the State Council. Article 12 Where a lessee rents a house for business activities, it shall apply to the engineering, taxation and other departments for relevant registration procedures. Article 13 The lessor shall pay relevant taxes and fees in accordance with the provisions of laws and regulations. Fourteenth no unit or individual may use the leased premises to engage in illegal and criminal activities that harm public interests.
The lessor and lessee shall obey the public security management of the leased house by the public security organ and strictly abide by the relevant national and provincial regulations on public security management.
The lessor and lessee shall strictly abide by the provisions of the state and province on family planning management. Chapter III Lease Contract Article 15 A lease contract shall meet the following conditions:
(1) The name and domicile of the party concerned;
(2) The location, area, structure and facilities of the house;
(3) the purpose of the leased house;
(4) Term of lease;
(five) the amount of rent and the mode of delivery;
(6) House maintenance agreement;
(7) Liability for breach of contract;
(eight) other terms agreed by the parties. Sixteenth parties may entrust others to rent or lease houses on their behalf.
The client shall hold a power of attorney. The power of attorney of the overseas party shall be notarized or authenticated as required. Article 17 A lease contract shall take effect once it is signed according to law. Both parties shall fully perform it, and neither party may change or terminate it without authorization. Eighteenth in any of the following circumstances, it is allowed to change or terminate the lease contract;
(1) The contract cannot be performed or fully performed due to force majeure;
(two) the parties reached an agreement through consultation, and it does not harm the public interest or the legitimate interests of others;
(three) the provisions of laws and regulations or the contract can be changed or terminated.
If the alteration or dissolution of the lease contract causes losses to one party, the party at fault shall be liable for compensation. If all parties are at fault, they shall share the responsibility according to the size of the fault.
