Does the company go bankrupt when it goes bankrupt?

When the company closes down or terminates the labor contract, the employing unit shall pay the economic compensation of one month's salary every year according to the working years of the employees in the unit, and one month's salary every year if it is over half a year but less than one year, and one and a half months' salary every year if it is less than half a year.

If the company cancels, it shall be handled as follows:

1. The industrial and commercial bureau put on record. Go to the local industrial and commercial bureau and fill out the filing application form, and set up a liquidation group with at least two members.

2. Go through the cancellation announcement, and after the approval of the Industrial and Commercial Bureau, go through the cancellation announcement, cancel the company's national tax registration certificate, and go to the bank to cancel the account.

3. Then go to the Quality Supervision Bureau to cancel the code certificate; Make an announcement in the newspaper and prepare the original tax cancellation certificate of the company's business license.

4. Company liquidation report. The forms received by the Industrial and Commercial Bureau and the original files of the company are complete, and all the certificates need to be audited by relevant departments.

Article 47 of the Labor Contract Law of People's Republic of China (PRC) * * * The economic compensation shall be paid according to the standard that the laborer pays one month's salary for each full year of working in this unit. For those who have spent more than six months but less than one year, and those who have spent six months in one year, they shall be paid economic compensation of half a month's salary. If the monthly salary of workers is three times higher than the average monthly salary of local workers announced by the people's government of the municipality directly under the central government or the city with districts where the employer is located, the standard for paying economic compensation to workers is three times the average monthly salary of workers, and the longest period for paying economic compensation to workers shall not exceed 12 years. The monthly salary mentioned in this article refers to the average salary of workers in the twelve months before the dissolution or termination of the labor contract.

Article 180 of the Company Law of People's Republic of China (PRC)

The Company is dissolved for the following reasons:

(1) The business term stipulated in the articles of association expires or other reasons for dissolution stipulated in the articles of association occur;

(2) The shareholders' meeting or shareholders' meeting decides to dissolve;

(3) The company needs to be dissolved due to merger or division;

(4) The business license is revoked, ordered to close or revoked according to law;

(5) The people's court shall be dissolved in accordance with the provisions of Article 182 of this Law.
