1, Labor Contract Law

Article 37 A laborer may terminate the labor contract by giving a written notice to the employing unit 30 days in advance. The employee may terminate the labor contract by notifying the employer three days in advance during the probation period.

2. The Labor Law and the Labor Contract Law have no clear provisions on personal leave. In practice, enterprises and employees generally agree on matters of personal leave in labor contracts, such as the maximum number of days of personal leave per month, otherwise they will be dismissed. At the same time, if the employee asks for personal leave, the enterprise will convert the corresponding deductible salary according to the actual working days of the employee.

3. Therefore, it is illegal for an enterprise not to allow employees to resign, and the leave needs to be determined by combining the employee handbook of the employer and the reasons for the employee's leave.
