Provisions of Shenzhen Municipality on the Supervision and Administration of Bean Products

Article 1 In order to standardize the production and operation order of bean products in our city, strengthen the supervision and management of bean products, and ensure people's health and safety, these Provisions are formulated in accordance with the provisions of the Food Hygiene Law of People's Republic of China (PRC), the Product Quality Law of People's Republic of China (PRC) and other laws and regulations, combined with the actual situation of this Municipality. Article 2 Whoever engages in the production, processing, sale, supervision and management of bean products within the administrative area of this Municipality shall abide by these Provisions. Article 3 The term "bean products" as mentioned in these Provisions refers to non-fermented bean products made from soybeans without fermentation, including bean curd, soybean milk, dried bean curd, oily bean curd, dried bean curd, fish plates and tofu.

The term "ready-to-eat bean products" as mentioned in these Provisions refers to the bean products that are directly consumed by consumers after on-site processing by catering operators in their business premises.

The technical specifications mentioned in these Provisions refer to the technical specifications for bean products promulgated and implemented with the approval of the municipal government.

The controlled operation area mentioned in these Provisions refers to the operation area where people flow, logistics and invasion of harmful substances must be strictly controlled in the production process. The controlled operation area includes a clean operation area and a quasi-clean operation area.

The catering industry mentioned in these Provisions refers to the food production and operation industries that provide food, consumption places and facilities to consumers through instant processing, commercial sales and service labor, including restaurants, snack bars and fast food restaurants. Except for the canteen. Article 4 The people's governments of all districts shall take overall responsibility for the safety of bean products in their respective jurisdictions, and uniformly lead, organize and coordinate the supervision of bean products.

The quality supervision department is responsible for the hygiene license and daily supervision of the production and processing of bean products.

The industry and commerce department is responsible for the daily supervision of the circulation of bean products.

The health department is responsible for the daily supervision of the hygiene license and consumption of bean products in circulation.

Urban comprehensive administrative law enforcement, environmental protection, industry and commerce departments are responsible for the relevant supervision work in accordance with relevant laws and regulations and the responsibilities determined by the municipal government. Article 5 A bean product producer or operator shall obtain a hygiene license according to law before applying for registration with the industrial and commercial department. Article 6 The bean products produced, processed and sold shall meet the requirements of relevant standards and technical specifications. Bean products production and processing enterprises should issue a "bill of lading for bean products" and send it with the goods to ensure the conformity of the single goods.

When purchasing bean products, bean product operators shall obtain the Bean Product Delivery Note, check the relevant contents, and ensure that the single goods are consistent and the single business is bright.

No unit or individual may forge or resell the "bill of lading for bean products".

The catalogue of bean products subject to the bill of lading system and the specific management measures shall be formulated separately by the municipal industrial and commercial department. Article 8 Enterprises engaged in the production, operation and distribution of soybean milk, bean curd and other bean products that need to be stored and transported at low temperature shall be equipped with corresponding cold storage, freezers and other facilities, and transported by a closed special refrigerated truck.

The refrigeration temperature in the production process should be 0℃ ~ 4℃, and the refrigeration temperature in the circulation, consumption and transportation process should be below 65438 00℃.

If laws, regulations, relevant standards or technical specifications clearly stipulate the refrigeration temperature and equipment of bean products, such provisions shall prevail.

The catalogue of low-temperature storage and transportation of bean products shall be announced separately by the municipal quality supervision department. Ninth bean products production and processing enterprises control the operating area of the use area shall not be less than 500 square meters. Tenth bean products should be pre-packaged, and the packaging materials should comply with the relevant provisions of the state.

Pre-packaged bean products should be labeled. Labels shall comply with relevant regulations and indicate the date of production. Eleventh bean products production and processing enterprises should set up quality inspection institutions, equipped with necessary testing instruments, equipment and personnel.

Bean products must be inspected before they can be sold. Twelfth bean products production and processing enterprises should establish a ledger, indicating the procurement of raw and auxiliary materials and product production, sales and other related information. Thirteenth bean products operators should establish a system of inspection and acceptance of incoming goods, check the quality and hygiene of bean products, and check the certificate, delivery note and label of bean products.

Bean product operators shall establish purchase and sale ledger, indicating the variety, specification, batch number, production unit, quantity and date. Fourteenth in addition to the catering industry, other bean products operators (including unit canteens) shall not be on-site processing and production of bean products.

The on-site processing and production of bean products in the catering industry shall meet the following requirements, meet the requirements of environmental protection, and obtain a hygiene license:

(a) there is an independent bean product production room for soaking, grinding and molding raw materials, with an area of not less than 30 square meters;

(two) bean products need to be refrigerated and insulated according to regulations, and equipped with corresponding facilities;

(three) the existing bean products are only for consumers to eat in their business premises, and shall not be sold to other bean products operators;

(four) the establishment of production, acquisition, batch sales records. Fifteenth relevant regulatory authorities shall, in accordance with their respective responsibilities, supervise and inspect soy products, and may exercise the following functions and powers according to law:

(a) on-site inspection of the production, sale and use of bean products;

(two) to investigate and understand the relevant situation, consult and copy the relevant records and materials;

(3) sealing up production and business premises, sealing up or detaining equipment, raw materials, products, etc. ;

(four) check or spot check the quality of soy products;

(five) other functions and powers as prescribed by laws, regulations and rules.

After taking other evidence preservation measures, the regulatory authorities may deal with the bean products that have been sealed up or detained first.
