Measures to promote the development of green buildings in Qinghai Province

Chapter I General Provisions Article 1 In order to promote the development of green buildings, save resources, improve the living environment and promote the construction of ecological civilization, these measures are formulated in accordance with the Energy Conservation Law of People's Republic of China (PRC), the Regulations of the State Council on Civil Building Energy Conservation and other laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to the planning, construction, operation and transformation of green buildings within the administrative area of this province, as well as the supervision, management, guidance and encouragement of the development of green buildings.

The term "green building" as mentioned in these Measures refers to a building that saves energy, land, water and materials to the maximum extent, protects the environment and reduces pollution, provides people with healthy, applicable and efficient use space, and is in harmony with nature.

According to the national green building evaluation standard, green buildings are divided into three grades: one star, two stars and three stars. Article 3 The development of green buildings shall follow the principles of policy guidance, local conditions, overall planning and social participation, and implement the architectural policy of being applicable, economical, green and beautiful. Fourth people's governments at or above the county level shall incorporate the promotion of green buildings into the national economic and social development plan, establish and improve the working mechanism, and comprehensively promote the development of green buildings. Fifth people's governments at or above the county level shall encourage and support the research, development, demonstration and popularization of green building science and technology, and promote the innovation and progress of green building technology. People's governments at all levels should strengthen the publicity and education of developing green buildings, popularize green architectural knowledge, and enhance the awareness of energy conservation of the whole people. Sixth people's governments at or above the county level shall be responsible for the guidance, supervision and management of the development of green buildings within their respective administrative areas.

The departments of development and reform, economy and informatization, finance, science and technology, land and resources, environmental protection, transportation and water conservancy of the people's governments at or above the county level shall, according to their respective responsibilities, do a good job in promoting the development of green buildings. Seventh implementation of green building development target responsibility assessment system, the specific assessment methods shall be formulated separately. Article 8 The competent department of housing and urban construction of the people's government at or above the county level shall establish and improve the credit system and reward and punishment mechanism for promoting the development of green buildings, do a good job in collecting, evaluating, determining, publishing and applying the credit information of construction units, design units, construction drawing review institutions, supervision units, energy efficiency evaluation institutions, real estate development enterprises and their employees, and implement trustworthy incentives and disciplinary actions against dishonesty. Ninth units and individuals that have made remarkable achievements in the development of green buildings shall be commended or rewarded. Chapter II Planning and Construction Article 10 The competent department of housing and urban construction of the people's government at or above the county level shall, jointly with the departments of development and reform, economy and informatization, land and resources, formulate a green building plan, which shall be implemented after being approved by the people's government at the same level.

Green building planning should define the development goals, key development areas and industrialization requirements of new buildings, and determine the grade requirements of green buildings. Eleventh provincial housing and urban construction departments shall, according to the actual situation of this province, jointly with the relevant departments to formulate and publish green building standards and green buildings, green building materials evaluation and labeling system.

Provincial housing and urban and rural construction departments shall formulate a catalogue of new technologies, new processes, new materials and new equipment to be promoted and used, as well as a catalogue of high energy-consuming technologies, processes, materials and equipment to be restricted or prohibited. Twelfth in the overall urban planning and town planning to determine the scope of urban construction land, new buildings should be built in accordance with green building standards.

Office buildings and public buildings of state organs shall be built in accordance with the green building standards of two or more stars. Encourage residential buildings to be built in accordance with the green building standards of two or more stars. Thirteenth transfer of state-owned construction land use rights, in the tender, auction or listing announcement, it should be based on the green building planning to express the green building grade requirements of the plot. Fourteenth new projects and filing documents shall include the requirements of green building grade, and clarify the green building technology selected for the project and its investment, energy saving and emission reduction benefits.

When establishing a project, the competent investment department shall include the requirements of green buildings in the scope of energy-saving assessment and review of fixed assets investment projects, and the project approval documents issued shall specify the requirements of green buildings. Fifteenth engineering design submitted by the construction unit shall be accompanied by energy-saving evaluation and review opinions.

When the construction unit entrusts the project design, preliminary design, construction drawing design and other construction project design documents, it shall specify the requirements of green building grade, and shall not require the design unit to design below the green building standard.

For newly-built office buildings and public buildings of state organs, the design unit shall clearly install the design contents of building energy itemized metering and data acquisition and transmission devices in the design documents, and the construction unit shall install them according to the design requirements.

The construction unit shall undertake the responsibility of quality assurance according to the grade of green building. Sixteenth design units in the preparation of scheme design, preliminary design, construction drawing design and other construction engineering design documents, should be clear about the requirements of green building grade, and prepare a special article on green building design. Seventeenth construction drawing design documents review institutions shall review the construction drawing design documents in accordance with the energy-saving assessment review opinions and green building construction drawing review points.
