Many people don't understand the labor law. How does the labor law stipulate working hours?

Our working hours are regulated. The labor law stipulates that the working hours should not exceed 8 hours a day, which is also the requirement of enterprises and units. The specific content is in Article 36 of the Labor Law, which can also be called legal working hours. If the specified time is exceeded, employees or workers have the right to refuse. Article 36 of the Labor Law stipulates that the state implements a working-hour system in which the daily working hours of laborers do not exceed 8 hours and the average weekly working hours do not exceed 44 hours. Forty-first due to the needs of production and operation, the employer may extend the working hours after consultation with the trade unions and laborers, generally not exceeding one hour per day; If it is necessary to extend working hours for special reasons, the extended working hours shall not exceed 3 hours per day and 36 hours per month under the condition of ensuring the health of workers.

When enterprises recruit employees, the basic salary usually set for employees is the minimum wage. In this case, workers can only earn higher wages by working overtime. Therefore, some workers subconsciously believe that they can only strive for higher wages by extending working hours. In fact, this is completely wrong. Workers' failure to report, complain and defend their rights is tantamount to acquiescing in the illegal activities of enterprises, which will only intensify. At the beginning, it may only make everyone work overtime for two hours every day, but later it will be extended to three hours and four hours, working 12 hours. In fact, the working hours stipulated by the state are to take care of the health and living standards of employees.

Facing the competition of selling goods, enterprises' profits become thinner and their income decreases. To change this dilemma, enterprises should not work overtime to produce more products, but should improve production efficiency or product quality, thus improving the profitability of enterprises. Otherwise, it can only be moved to areas with lower labor costs or closed down. It is also a reality that many labor-intensive industries in China have moved to Vietnam, India and other regions.

So to be honest, even if private enterprises let employees work 12 hours a day, as long as employees don't get feedback from the labor department, it is difficult to solve the problem effectively. I think the labor department needs to strengthen the management of working hours in enterprises. Enterprises, especially private enterprises with irregular management, should be more considerate of employees' difficulties, more humane ideas, give employees more rest time and less overtime.
