Is it legal to sign a contract with a subsidiary to work in the head office?

Legal analysis: working in the company headquarters, the labor contract of the subsidiary company is signed, and the laborer needs to determine the subject of establishing labor relations. If the main body of labor relations is a subsidiary, and the employer arranges the workers to work in the company headquarters, then it is no problem to sign a labor contract with the subsidiary. Otherwise, the laborer may request to sign a labor contract with the head office.

Legal basis: Branch companies can be established in Article 14 of People's Republic of China (PRC) Company Law. The establishment of a branch company shall apply to the company registration authority for registration and obtain a business license. A branch company does not have legal person status, and its civil liability shall be borne by the company. A company may set up subsidiaries, which have legal personality and independently bear civil liabilities according to law.
