Regulations of Yingtan Municipality on the Protection of Drinking Water Sources in Xinjiang

Chapter I General Provisions Article 1 In order to protect the drinking water sources in Yingtan City, Xinjiang, improve the quality of drinking water, and ensure the safety of drinking water, these Regulations are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Water Pollution and in combination with the actual situation of this Municipality. Article 2 The term "drinking water sources in Xinjiang" as mentioned in these Regulations refers to the drinking water sources used for centralized water supply in urban and rural areas in yingtan section of Xinjiang (including first-class tributaries).

Drinking water sources in Xinjiang should be protected.

These Regulations shall apply to the protection and related management activities of drinking water sources and protected areas in Xinjiang within the administrative area of this Municipality. Article 3 The protection of drinking water sources in Xinjiang shall follow the principles of scientific planning, giving priority to prevention, giving priority to protection, comprehensive management, supervision according to law and ensuring safety. Article 4 The municipal, district (city) people's governments (administrative committees) and relevant township people's governments (street offices) shall be responsible for the environmental quality of drinking water sources in Xinjiang within their respective jurisdictions.

When the municipal, district (city) people's governments report the environmental conditions and the completion of environmental protection targets to the people's congresses at the corresponding levels or their standing committees every year, they shall report the protection of drinking water sources in Xinjiang within their respective administrative areas and make it public.

The relevant township people's governments shall report to the township people's congresses on the protection of drinking water sources in Xinjiang within their respective administrative areas every year.

The relevant village (neighborhood) committees shall assist in the protection of drinking water sources in Xinjiang within their respective jurisdictions. Article 5 The competent department of ecological environment shall exercise unified supervision and management over the protection of drinking water sources in Xinjiang, and the departments of water administration, agriculture, forestry, natural resources, urban and rural construction, urban management, industry and information technology, public security, transportation, maritime affairs and emergency management of the municipal and district (city) people's governments (administrative committees) shall, in accordance with their statutory duties, do a good job in relevant protection. Article 6 The municipal, district (city) people's governments (administrative committees) shall incorporate the protection of drinking water sources in Xinjiang into the target management assessment and the outgoing audit of natural resources assets of leading cadres. Seventh city, district (city) people's government (CMC) shall establish a compensation mechanism for the protection of drinking water sources in Xinjiang, and promote the protection and management of drinking water sources in Xinjiang within their respective jurisdictions. Article 8 The municipal and district (city) people's governments (administrative committees) shall build emergency standby water source projects or pipe network water supply, establish and improve emergency water source protection measures, and formulate emergency plans for urban and rural drinking water safety. Article 9 All units and individuals have the obligation to protect drinking water sources in Xinjiang, and have the right to stop and report acts of polluting drinking water sources and destroying drinking water source protection facilities.

City, district (city) people's government (CMC) and its relevant departments shall commend and reward the units and individuals that have made remarkable achievements in the protection of drinking water sources in Xinjiang. Article 10 The organs and relevant organizations prescribed by law may bring public interest litigation against the acts of polluting drinking water sources in Xinjiang. Chapter II Protection of Drinking Water Sources Article 11 The drinking water source protection areas in Xinjiang are divided into first-class protection areas and second-class protection areas.

Xinjiang drinking water sources used for water supply in cities and county-level cities should be designated as quasi-protected areas. Xinjiang drinking water sources used for water supply in enterprises and towns can be designated as quasi-protected areas according to needs.

Yingtan Municipal People's Government and guixi city Municipal People's Government shall, in accordance with the procedures prescribed by laws and regulations and the requirements of the technical specifications for the division of drinking water source protection areas, put forward a plan for the delineation of drinking water source protection areas and quasi-protection areas in Xinjiang and submit it to the provincial people's government for approval. Twelfth legally designated drinking water source protection areas and quasi-protection areas in Xinjiang shall not be adjusted without authorization. If it is really necessary to adjust the water intake due to changes and other reasons, the adjustment plan shall be put forward in time and submitted for approval in accordance with the prescribed procedures. Thirteenth city, district (city) people's government (Administrative Committee) shall, in accordance with the technical requirements of the national drinking water source protection zone, set up clear geographical landmarks and obvious warning signs at the boundary between the drinking water source protection zone and the quasi-protection zone. Isolation and protection facilities should be set up in areas with frequent production and living activities around the first-class protection zone of drinking water sources.

No unit or individual may damage or move the geographical landmarks, warning signs and isolation protection facilities of drinking water source protection areas and quasi-protection areas without authorization. Article 14 The water quality of the first-class protected areas of drinking water sources in Xinjiang shall be subject to the second-class standard of the National Environmental Quality Standard for Surface Water, and the water quality of the second-class protected areas and quasi-protected areas shall be subject to the third-class standard of the National Environmental Quality Standard for Surface Water. Fifteenth in Xinjiang waters and flood levees on both sides of the prohibited the following acts:

(1) Discharging oil, acid liquor, alkali liquor and other waste liquids that pollute water bodies into water bodies;

(two) cleaning vehicles and containers that have been filled with oil or toxic pollutants in water;

(3) Discharging or dumping radioactive solid waste or waste water containing highly radioactive and moderately radioactive substances into water bodies;

(4) Discharging or dumping industrial waste residue, urban garbage and other wastes into water bodies;

(5) Discharging residual oil or waste oil from ships or dumping ship garbage into water bodies;

(6) Discharging, dumping or directly burying soluble toxic waste residues containing mercury, cadmium, arsenic, chromium, lead, cyanide and yellow phosphorus into water bodies;

(seven) stacking and storing solid wastes and other pollutants on beaches and bank slopes below the highest water level;

(8) Electric fish, poisonous fish and fried fish;

(nine) other acts prohibited by laws and regulations.
