1. On-the-job or off-the-job party and government leading cadres who have not gone through the formalities of retiring (leaving) are not allowed to work or take part-time jobs in enterprises, and even if they are approved to take part-time jobs in enterprises according to regulations, they are not allowed to obtain equity in enterprises.
2. Party and government leading cadres shall not establish commercial enterprises after retirement, that is, they shall not be shareholders of for-profit companies.
3. Within three years after resigning from public office, party and government cadres may not hold shares of the company related to the business under the jurisdiction of their original positions, but they may hold shares of the company outside the business under the jurisdiction of their original positions.
4. Party and government cadres can hold company shares three years after resigning from public office. However, if the part-time job (post) of the company is involved, it should be reported to the party committee (party group) of its original unit, and the enterprise that intends to take a part-time job (post) will issue the reasons for the part-time job, which will be examined and approved by the party committee (party group) of the unit according to the regulations, and put on record with the corresponding organization (personnel) department according to the cadre management authority.
Legal basis: Article 18 of the Interim Provisions on the Punishment of Staff in Public Institutions shall be given a warning or a demerit for any of the following acts; If the circumstances are serious, demotion or dismissal shall be given; If the circumstances are serious, be dismissed:
(a) corruption, bribery, bribery, embezzlement;
(2) taking advantage of his work to seek illegitimate interests for himself or others;
(3) accepting gifts, various securities and payment vouchers in official activities or work;
(4) Seeking benefits by using known or mastered inside information;
(5) Traveling with public funds or traveling with public funds in disguise;
(six) in violation of state regulations, engaged in profit-making activities or part-time remuneration;
(seven) other acts in violation of integrity discipline.
Whoever commits the act mentioned in Item (1) of the preceding paragraph shall be given a demerit or above.
