What if the company doesn't pay wages on the grounds of no performance?

Legal analysis: It is illegal for the company not to pay wages, but the company can evaluate the performance of employees according to the contract. If the employee fails to meet the performance requirements, the employer may not pay extra bonus or commission, but it is illegal to deduct the employee's salary. How the company operates depends on the specific situation.

Legal basis: Article 9 of People's Republic of China (PRC) Labor Arbitration Law. If the employing unit violates state regulations and fails to pay labor remuneration in full, or fails to pay medical expenses, economic compensation and work-related injury compensation, the employee may complain to the labor administrative department, which shall handle it according to law.
