What if the company goes bankrupt and the legal person runs away?

Legal analysis: 1. Apply to the local labor department for arbitration. Because the establishment of labor relations between the company and employees does not affect employees' rights protection measures after the company boss runs away, employees can still apply to the labor department for arbitration. Moreover, to apply for labor arbitration, you need to fill in the labor complaint, submit the proof of the existence of labor relations, and the specific amount of wages owed. 2. Apply to the court for asset preservation and liquidate the assets of the auction company. Because after the collapse of the company, the company's creditors not only have employees who are owed wages, but also other corporate creditors. Therefore, in order to get paid as soon as possible, employees need to take this approach. In addition, if the company enters bankruptcy proceedings, employees can not only recover their wages, but also get economic compensation according to law. Moreover, the economic compensation should be paid according to the following standards: 1, and one month's salary should be paid every year according to the years of employees working in the company; 2 employees who have worked for more than six months but less than one year shall be calculated according to the standard of one year; 3. If the employee works for less than six months, it shall be calculated according to the standard of half a month's salary; 4. If the monthly salary of employees is three times higher than the average monthly salary of local employees announced by the people's government of the municipality directly under the central government or the city with districts where the company is located, economic compensation shall be paid according to the amount of three times the average monthly salary of employees.

Legal basis: Article 43 of the Enterprise Bankruptcy Law of the People's Republic of China, bankruptcy expenses and beneficial debts shall be paid off by the debtor's property at any time. If the debtor's property is insufficient to pay off all bankruptcy expenses and debts, the bankruptcy expenses shall be paid off first. If the debtor's property is insufficient to pay off all bankruptcy expenses or beneficial debts, it shall be paid off in proportion. If the debtor's property is insufficient to pay off the bankruptcy expenses, the administrator shall request the people's court to terminate the bankruptcy proceedings. The people's court shall, within 15 days from the date of receiving the request, make a ruling to terminate the bankruptcy proceedings and make an announcement.
