It is illegal for Ping An Insurance Company to impose a fine on an on-the-job salesman who has not invoiced.

According to Article 4 of the Labor Contract Law of People's Republic of China (PRC), the employing unit shall establish and improve labor rules and regulations in accordance with the law, so as to ensure that workers enjoy labor rights and perform labor obligations. Whether the rules formulated by the company are established according to law needs to be clearly stipulated by law, which involves whether the company enjoys the right to punish employees.

According to Article 3 of the Supplementary Provisions of the Ministry of Labor on Printing and Distributing the Interim Provisions on Wage Payment, the term "deduction" in Article 15 of the Provisions means that the employer deducts the wages due to the laborer without justifiable reasons (that is, the employer shall pay all the labor remuneration to the laborer according to the standards agreed in the labor contract on the premise that the laborer has provided normal labor). Excluding the following wage reductions:

(1) is clearly stipulated by national laws and regulations;

(2) clearly stipulated in the labor contract signed according to law;

(3) It is clearly stipulated in the factory rules and regulations formulated by the employer according to law and adopted by the workers' congress;

(4) The total wages of enterprises are related to economic benefits. When economic benefits go down, wages must go down, but the wages paid to workers shall not be lower than the local minimum wage);

(5) Wage reduction due to employee's personal leave and other reasons. According to the provisions in (2) and (3) above, if the company incorporates into the rules and regulations the provision that "employees bring materials to process personal articles privately during working hours and deduct 500 yuan's fine from the salary of the current month", if the employees violate the rules and regulations and meet the requirements, the company will deduct the fine from the salary of the employees of the current month, which does not belong to Article 15 of the Interim Provisions on Wage Payment and Article 54 of the Regulations on Wage Payment in Guangdong Province.
