Legal analysis: To apply for public fundraising qualification, a charitable organization shall submit the following materials to the civil affairs department of the place of registration: an application, including a specific explanation and written commitment that the organization meets the conditions of Article 5; The financial audit report issued by the certified public accountant for the two years before the application, including the special audit of the annual charity expenditure and the annual management expenses; A charitable organization with a competent business unit shall also submit certification materials approved by the competent business unit.

Article 10 To establish a charitable organization, an application for registration shall be submitted to the civil affairs department of the people's government at or above the county level, and the civil affairs department shall make a decision within 30 days from the date of accepting the application. Those who meet the requirements of this law shall be registered and announced to the public; If it does not meet the requirements stipulated in this law, it shall not be registered and the reasons shall be explained in writing. Non-profit organizations such as foundations, social organizations and social service institutions established before the promulgation of this Law may apply to the civil affairs department of their place of registration for recognition as charitable organizations, and the civil affairs department shall make a decision within 20 days from the date of accepting the application. Those who meet the conditions of charitable organizations shall be identified and announced to the public; Those who do not meet the conditions of charitable organizations shall not be recognized, and the reasons shall be explained in writing. There are special circumstances that need to extend the registration or identification period, which may be appropriately extended after approval by the civil affairs department of the State Council, but the extension period shall not exceed 60 days.

Article 38 When accepting donations, charitable organizations shall issue a donation (seal) system under the unified supervision of the financial department to the donors. The donation bill shall specify the donor, the type and quantity of the donated property, the name of the charity organization and the name of the agent, the date of the bill, etc. If the donor is anonymous or refuses to accept the donation bill, the charity organization shall make relevant records.
