How does the new express delivery standard balance the interests of consumers and express delivery companies?

Official website, the State Post Bureau, issued the Notice on Soliciting Opinions on National Standards for Express Service (Draft for Soliciting Opinions). One of the biggest changes in the new national standard is the classification and refinement of the delivery methods. Delivery methods should mainly include door-to-door delivery, delivery to intelligent delivery service terminal (box delivery) and delivery to express service station (station delivery). Another major change in the new national standard-subdividing user orders into two ways: ordering through express service providers and ordering through e-commerce platforms.

The new national standard clearly points out in "Delivery Time" that the main body of express delivery service should provide at least two free deliveries for express delivery, and the delivery time is 8: 00-20: 00. The interval between two free deliveries should be more than 8 hours, unless there is an agreement with the user.

For the express mail that fails to be delivered twice at home, the courier service subject can agree with the recipient to deliver it by delayed delivery or box delivery or station delivery; If the recipient still chooses to deliver the goods to the door, the courier service subject may charge extra fees, but it shall inform the recipient of the charging standard in advance. If the recipient cannot be contacted, the express mail can be handled according to the sender's requirements.

In addition, the user's order is subdivided into two ways: ordering through the express service subject and ordering through the e-commerce platform. E-commerce operators shall truthfully provide the sender's name, contact information and the recipient's name, contact information, address, commodity name and other necessary information to the courier service subject, and shall not make unreasonable restrictions or attach unreasonable conditions by using service agreements, trading rules and technologies.

So who will benefit from the revision of the national standard for express delivery services?

The classification of delivery methods is refined, which balances the interests between consumers and express service providers.

Lawyer CoCo Lee, a special researcher of E-commerce Research Center of Network Economy and Social Security and a senior partner of Shanghai Hansheng Law Firm, said that the draft did not specify whether there was a priority among various delivery methods such as "box delivery", "station delivery" and "door delivery", so users could choose when placing an order.

As for the door-to-door charges, the delivery times of 5.4.2.3, the service link in the third part of the opinion draft, stipulates that the express delivery service subject should provide at least two free deliveries for door-to-door delivery of express mail, and the delivery time is 8: 00-20: 00.

In this regard, lawyer CoCo Lee believes that this provision in the opinion draft is also an absorption of local successful experience. Article 26 of Nanjing Postal Regulations made by the Standing Committee of Nanjing Municipal People's Congress on 20 16 stipulates that if the recipient still needs to deliver undelivered express mail after two free deliveries due to the reasons of the recipient or the consignee, the express delivery enterprise may charge an additional fee, but it shall inform the recipient of the charging standard in advance.

"Due to the recipient's reasons, the door-to-door delivery failed many times, which greatly increased the risk and cost of express delivery service providers, especially the express delivery of large items and valuables. However, such items only account for a small part of the express delivery business, and most of the items that fail to be delivered by express delivery can be solved by other means after contacting consumers. Therefore, the charge for "door-to-door delivery" in the opinion draft is a balance between the interests of consumers and express service providers. " Li Wei added.

Chen Hudong, a special researcher at the Research Center for E-commerce of NetEconomy & Society, said that the old national standard should mainly include three delivery forms: face-to-face delivery by name and address, self-delivery by users or delivery through consultation with users, while the new standard includes door-to-door delivery, box delivery and station delivery. To a great extent, the new standard shows that the previous service standard can't basically meet the status quo, but now it gives more initiative to consumers, and based on the consideration of consumers, the satisfaction scenarios are more diverse. In other words, for the main body of express delivery service, consumers need to be really informed, the information needs to be more transparent, and the terms of service with consumers need to be more clear; In addition, giving the choice of service to consumers, in fact, for the main body of express delivery service, the service performance will be more clear, reducing the entanglement cost of both parties. For consumers, the initiative of choice is in their own hands, which also reduces the related costs of "ignorance".

It is conducive to balancing the position of e-commerce and express delivery companies in the express delivery development industry.

According to CoCo Lee's lawyer, in recent years, due to the stricter requirements for personal information protection and the more urgent demand, personal information leakage in express logistics is serious. Some e-commerce companies have adopted the method of desensitizing and encrypting user information, and express logistics is not open, or they have established cooperation with express companies to generate privacy sheets from the moment consumers place orders. However, this practice strengthens the dominant position of e-commerce platform, increases the cost for express delivery companies to properly obtain consumer information, and is not conducive to the express delivery industry to accumulate its own industry data and feed back the development of the industry. Under the premise of protecting consumers' personal information, the new standard of opinion draft is conducive to balancing the position of e-commerce operators and express delivery enterprises in the express delivery development industry, and safeguarding the legitimate rights of express delivery enterprises to accumulate customer base and promote the development of data economy in the industry.
