Legal basis: Notice of the State Council on listing tungsten, tin, antimony and ionic rare earth minerals as specific minerals for national protective mining.
2. The State prohibits mining enterprises owned by the whole people and collectively from cooperating with foreign capital to jointly exploit ionic rare earth minerals. Without the approval of the the State Council Rare Earth Leading Group, no unit or individual may receive personnel without Chinese identity cards or provide them with geological data, ore samples and production technology.
Three, where the exploitation of tungsten, tin, antimony, ionic rare earth minerals or the exploitation of these minerals-based national and collective mining enterprises must be approved by China Nonferrous Metals Industry Corporation and the State Council Rare Earth Leading Group. With the approval documents, the examination and approval procedures for the establishment of mining enterprises shall be handled in accordance with the provisions of Articles 13 and 14 of the Mineral Resources Law. Issuing mining licenses to mining enterprises owned by the whole people shall be handled in accordance with the Interim Measures for the Administration of Mining Registration of Mining Enterprises Owned by the Whole People and the Decision of the State Council Municipality on Amending the Interim Measures for the Administration of Mining Registration of Mining Enterprises Owned by the Whole People; The issuance of mining licenses for collective mining enterprises shall be handled by the institutions authorized by the standing committees of the people's congresses of provinces, autonomous regions and municipalities directly under the Central Government in accordance with the provisions of Article 14 of the Mineral Resources Law.
