First of all, we can't adopt a one-size-fits-all model. There are mass aquaculture and small food processing plants in some areas. These small enterprises have their own space from the beginning. On the one hand, operators can generate income through operations and solve some employment problems of local farmers. On the other hand, it also provides some convenience for the production and life of nearby villagers, and needs to be treated differently.
Secondly, we should make reasonable compensation. A considerable number of small and medium-sized enterprises have obtained corresponding licenses, which can prove that enterprises meet relevant regulations when they are established according to law. With the development of economy, it may not conform to the adjustment of national industrial structure or the planning and layout should be prohibited, and the government should compensate it according to the principle of protection of trust interests in administrative law. Article 8 of the Administrative Licensing Law stipulates that the administrative license obtained by citizens, legal persons or other organizations according to law shall be protected by law, and the administrative organ shall not change the administrative license that has come into effect without authorization. If the laws, regulations and rules on which the administrative license is based are amended or abolished, or the objective circumstances on which the administrative license is granted have changed significantly, the administrative organ may change or withdraw the effective administrative license according to law for the needs of public interest. If property losses are caused to citizens, legal persons or other organizations, the administrative organ shall make compensation according to law. This article provides the corresponding basis for the certified enterprises to claim reasonable compensation.
As a citizen, Beijing Wu Law Firm believes that we firmly support the environmental protection plan issued by the State Environmental Protection Administration, but specific government departments should also implement it in accordance with laws and regulations. Enterprises with relevant licenses can be rectified according to law. Those that cannot be rectified or do not conform to relevant industrial policies or planning adjustments must be dismantled according to law and given reasonable compensation.
