According to Xinhua News Agency, Haikou, September 15 (Reporter Vivian Chow), the detention of the China "Henna" by a court in Jeju, South Korea caused a heated discussion, with more than 2,300 people on board, including 1659 passengers stranded in Jeju for more than 40 hours. However, the cause of the incident was an economic dispute between Daxinhua Ship under HNA Group and Shagang Shipping under Jiangsu Shagang Group.

Who "made" the incident of "Henna" being detained abroad?

It is understood that the "Henna" cruise ship of HNA Sightseeing Cruise Yacht Management Co., Ltd. was originally scheduled to sail from Jeju to Incheon on September 3 16:00 local time, but it was detained by Jeju District Court when it left Hong Kong. At this time, there are 1659 passengers and 650 employees in the car.

Shagang Shipping Co., Ltd. (registered in Hong Kong) and Daxinhua Shipping Co., Ltd. (registered in Hong Kong), a subsidiary of HNA Group's Daxinhua Logistics Group, signed a charter agreement on August 6, 2008, that is, Shagang Shipping Co., Ltd. leased a large ship named Cape of Good Hope from Daxinhua Company, and HNA Group issued a letter of guarantee for Daxinhua Company. In this regard, Shagang Shipping submitted an arbitration application to the London Arbitration Tribunal according to the contract.

20 12 1 1.2, the arbitral tribunal ruled that Daxinhua Company should pay Shagang Shipping 58.3757 million US dollars (excluding about 7 million US dollars of interest and legal fees). At the same time, Shagang Shipping filed a lawsuit in the British High Court, demanding that HNA Group fulfill its guarantee obligations.

According to the explanation, Daxinhua Company has entered the bankruptcy liquidation procedure in Hong Kong due to the arrears of rent by all parties. Therefore, HNA Group, as a guarantor, must fulfill its guarantee responsibility. Shagang Shipping has communicated with HNA Group for many times and asked it to fulfill its guarantee responsibility according to law, but HNA Group refused. Against the background of fruitless efforts, Shagang Shipping Company had to pursue the assets of HNA Group on a global scale and submitted an application for seizing the assets of HNA Group to Jeju District Court of South Korea. On September 13, Jeju District Court ruled to detain the cruise ship "Henna" in accordance with judicial procedures.

Shagang said that according to the contract agreement between the two companies, when a debt dispute occurs, the London court ruling will apply. Upon the application of the creditor, the ship of the debtor or guarantor may be arrested at any port.

Hainan Airlines said that after receiving the notice that the Henna was detained in Jeju Island on the afternoon of June 5438+03, it immediately began to arrange the release of the ship, and paid the deposit of 3 billion won (equivalent to RMB 1688 yuan) required by the notice of arrest to the local Korean lawyer account at 3 am on September 14, but due to the weekend, the deposit could not be paid to Jeju in time.
