Chapter I General Provisions
Article 1 In order to strengthen the supervision and management of production safety in metallurgical enterprises, prevent and reduce production safety accidents and occupational hazards, and ensure the life safety and health of employees, these Provisions are formulated in accordance with the Safety Production Law and other laws and administrative regulations.
Article 2 These Provisions shall apply to the safety production, supervision and management of ironmaking, steelmaking, steel rolling, ferroalloy production and auxiliary process links matching the main process flow in iron and steel enterprises.
Article 3 state administration of work safety shall supervise and administer metallurgical safety production throughout the country.
The safety production supervision and management departments of the local people's governments at or above the county level shall, in accordance with the principle of territorial supervision and graded responsibility, supervise and manage the metallurgical safety production work within their respective administrative areas.
Article 4 Metallurgical enterprises are the main body responsible for production safety, and the main person in charge is the first person responsible for production safety in their own units. Relevant responsible persons are responsible for the safety production of their own units within their respective responsibilities. The group company is responsible for the safety production of its subsidiaries and holding companies.
Chapter II Safety
Article 5 Metallurgical enterprises shall abide by the laws, regulations, rules, national standards or industrial standards related to production safety.
Units that produce dangerous chemicals such as coking, oxygen production and related gases, gas production (excluding recycling) shall obtain the safety production license of dangerous chemicals production enterprises in accordance with relevant state regulations.
Article 6 Metallurgical enterprises shall establish and improve the responsibility system for production safety and the management system for production safety, and improve the safety technical operation procedures for various jobs and posts.
Article 7 Metallurgical enterprises with more than 300 employees shall set up safety production management institutions, and be equipped with full-time safety production management personnel according to the ratio of not less than 3‰ of employees; Employees in less than 300 people, should be equipped with full-time or part-time safety production management personnel.
Article 8 Metallurgical enterprises shall ensure the capital investment required for safe production and use it in the following scope:
(a) improve, transform and maintain safety protection equipment and facilities;
(two) safety education and training and labor protection supplies;
(3) Safety evaluation, monitoring of major hazard sources, evaluation and rectification of major accidents;
(4) Prevention and control of occupational hazards, detection and monitoring of occupational hazard factors and occupational health examination;
(five) safety performance inspection of equipment and facilities;
(six) emergency rescue equipment, equipment and emergency rescue drills;
(seven) other projects or activities directly related to production safety.
Article 9 The principal responsible persons and safety production management personnel of metallurgical enterprises shall receive safety production education and training, and have the knowledge and management ability of safety production suitable for the production and business activities of their own units. Special operations personnel must undergo special safety training and assessment in accordance with the relevant provisions of the state and obtain the qualification certificate for special operations before taking up their posts.
Metallurgical enterprises shall regularly carry out safety education and training for employees to ensure that employees have the necessary knowledge of safety production, understand the relevant laws and regulations on safety production, be familiar with rules and regulations and safety technical operation procedures, and master the safety operation skills of their posts. Employees who have not passed the safety education and training are not allowed to work at their posts.
Metallurgical enterprises shall, in accordance with the relevant provisions, train personnel engaged in gas production, storage, transportation, use, maintenance and repair in basic knowledge of gas safety, gas safety technology, gas monitoring methods and gas poisoning emergency rescue technology. , after passing the examination, can arrange mount guard work.
Article 10 The safety facilities and occupational hazard protection facilities of new construction, reconstruction and expansion projects of metallurgical enterprises (hereinafter referred to as construction projects) must comply with the provisions of laws, regulations, rules and national or industrial standards related to production safety, and be designed, constructed, put into production and use simultaneously with the main project (hereinafter referred to as "three simultaneities"). Investment in safety facilities and occupational hazard protection facilities shall be included in the budgetary estimate of construction projects.
The construction unit is responsible for the "three simultaneities" of the safety facilities of the construction project.
The construction unit shall, in accordance with the relevant provisions, organize the design review and completion acceptance of the safety facilities of the construction project.
Eleventh construction projects in the feasibility study stage should be entrusted with the corresponding qualifications of the intermediary agencies for safety pre-evaluation.
The preliminary design of a construction project shall select a design unit with corresponding qualifications and prepare a special safety article in accordance with the regulations. The safety special article shall include the contents of the safety pre-evaluation report, and comply with the provisions of relevant laws, regulations, rules, national standards or industry standards on safety production.
Twelfth construction project safety facilities shall be constructed by construction units with corresponding qualifications. The construction unit shall carry out the construction according to the design scheme and be responsible for the construction quality of safety facilities.
Major changes in the design of safety facilities of construction projects shall be approved by the original design unit and reported to the safety production supervision and management department for the record.
Thirteenth after the completion of the safety facilities of a construction project, an intermediary institution with corresponding qualifications shall be entrusted to conduct safety acceptance evaluation. The safety facilities of construction projects can be put into production and use only after they have passed the acceptance test.
Safety pre-evaluation report, safety special article and safety acceptance evaluation report shall be reported to the safety production supervision and management department for the record.
Fourteenth metallurgical enterprises should identify all kinds of hazards existing in their own units and implement hierarchical management. To constitute a major hazard source, it should be registered, regularly tested, evaluated and monitored, and reported to the safety production supervision and management department for the record.
Article 15 Metallurgical enterprises shall, in accordance with the relevant provisions of the state, strengthen the prevention and control of occupational hazards and occupational health monitoring, take effective measures to control occupational hazards, and ensure that the occupational health conditions in workplaces meet the provisions of laws, administrative regulations, national standards or industrial standards.
Radioactive sources for measurement and detection shall obtain licenses for the use of radioactive substances in accordance with relevant regulations.
Sixteenth metallurgical enterprises should establish a hidden danger investigation and management system and carry out safety inspection; The hidden dangers of accidents found in the inspection shall be rectified in time; If the rectification cannot be completed temporarily, a specific rectification plan shall be formulated and reliable safety guarantee measures shall be taken. Inspection and rectification shall be recorded.
Seventeenth metallurgical enterprises should strengthen the safety management of construction, maintenance and other engineering projects and production and operation projects and places (hereinafter referred to as engineering projects), and shall not contract out engineering projects to units without corresponding qualifications. The project contract agreement shall clearly stipulate the safety production responsibilities and obligations of both parties. The cost of safety measures should be included in the project contracting cost.
Metallurgical enterprises should be fully responsible for the safe production of engineering projects, and contractors should obey unified management and be specifically responsible for the on-site safety management of engineering projects.
Do not subcontract the project or illegally subcontract it.
Eighteenth metallurgical enterprises should recruit workers from legal labor service companies, and sign contracts with labor service companies to conduct unified safety education and training for workers.
Article 19 Metallurgical enterprises shall establish and improve the emergency rescue system for accidents, formulate corresponding emergency plans, equip them with necessary emergency rescue equipment, regularly carry out emergency publicity, education, training and drills, and review and record the emergency plans in accordance with regulations.
Article 20 Metallurgical enterprises shall establish file management systems such as safety inspection and hidden danger rectification records, safety training records, accident records, employee health monitoring records, hazard management records, safety fund investment and use records, safety management ledgers, labor protection articles distribution ledgers, "three simultaneities" review and acceptance materials, relevant design materials and drawings, safety pre-evaluation reports, safety articles and safety acceptance evaluation reports. , and timely report the documents, reports and records related to production safety.
Article 21 Meeting rooms, activity rooms, lounges, changing rooms and other crowded places of metallurgical enterprises shall be set in safe places, and shall not be set within the influence range of high-temperature liquid metal lifting.
Twenty-second buildings (structures) in metallurgical enterprises that bear heavy loads and are harmed by high-temperature radiation, hot slag splashing, acid-base corrosion, etc. shall be appraised regularly in accordance with relevant regulations.
Article 23 Metallurgical enterprises should set up fixed gas detection and alarm devices, establish early warning systems, hang eye-catching safety warning signs and strengthen ventilation in places where gas leakage and accumulation may occur, such as gas storage tanks.
Personnel working in gas areas should carry gas detection and alarm instruments; Before operation, check the gas content in the workplace and take reliable safety protection measures. Check that the gas content meets the requirements before starting the operation.
Article 24 the oxygen system should take reliable safety measures to prevent oxygen explosion accidents and nitrogen, argon, pearlescent sand suffocation accidents.
Twenty-fifth metallurgical enterprises should equip their employees with labor protection articles that are suitable for their jobs and meet national standards or industry standards, and supervise and educate employees to wear and use them in accordance with the rules of use.
Employees should strictly abide by the safety production rules and regulations and operating procedures of the unit, obey management, and wear and use labor protection articles correctly.
Twenty-sixth metallurgical enterprises to produce, transport, use and store dangerous chemicals such as gas, oxygen and hydrogen, as well as oil depots, cable tunnels (trenches) and other key fire prevention parts, should take effective and reliable fire and explosion prevention measures in accordance with relevant regulations.
Article 27 Metallurgical enterprises shall scientifically and reasonably determine the volume of gas cabinets, reasonably select cabinets and set up safety protection devices according to the actual situation of safety production in their own units, and formulate emergency plans for gas cabinet accidents in accordance with the provisions of the Gas Safety Regulations for Industrial Enterprises (GB6222).
Article 28 Metallurgical enterprises shall regularly inspect and verify safety equipment, facilities and safety protection devices. Equipment that has exceeded its service life and does not meet the national industrial policy should be scrapped in time. Updating or transforming existing equipment and facilities shall not reduce their safety and technical performance.
Twenty-ninth metallurgical enterprises should formulate corresponding safety technical measures and emergency plans before engaging in maintenance operations, and organize their implementation. Safety technical measures and emergency plans for dangerous maintenance operations shall be reviewed and approved by the organization responsible for safety production management of the unit. When hot work is carried out in areas where fire and explosion may occur, the hot work approval system shall be implemented in accordance with relevant regulations.
Thirtieth metallurgical enterprises should actively carry out safety production standardization work, and gradually improve the safety production level of enterprises.
After a production safety accident occurs in a metallurgical enterprise, it shall promptly report to the safety production supervision and management department and relevant departments in accordance with relevant regulations, and organize emergency rescue for the accident.
Chapter III Supervision and Administration
Thirty-first production safety supervision and management departments and their supervisors and inspectors shall strengthen the supervision and inspection of production safety in metallurgical enterprises, and impose administrative penalties on violations of laws, regulations, rules, national standards or industry standards and these Provisions.
Thirty-second production safety supervision and management departments shall establish and improve the filing management system of safety pre-evaluation, safety articles and safety acceptance evaluation of construction projects, and strengthen the supervision and inspection of the "three simultaneities" of safety facilities of construction projects.
Thirty-third production safety supervision and management departments should strengthen the training of metallurgical professional knowledge of supervision and inspection personnel, and improve the ability of administrative law enforcement.
The safety production supervision and management department shall provide necessary personal protective equipment and monitoring and inspection instruments for the personnel who enter the specific workplaces of metallurgical enterprises for supervision and inspection.
Thirty-fourth supervision and inspection personnel to perform supervision and inspection tasks, must produce valid law enforcement certificates, and by two or more people * * * jointly; Inspection and handling shall be recorded according to law. The technical secrets and business secrets of the inspected units shall be kept confidential.
Thirty-fifth production safety supervision and management departments should strengthen the filing management of emergency plans of metallurgical enterprises within their respective administrative areas, and incorporate the emergency rescue of major metallurgical accidents into the overall emergency rescue system of local people's governments.
Chapter IV Punishment
Thirty-sixth supervision and inspection personnel in the supervision and inspection of metallurgical enterprises, abuse their powers, neglect their duties, engage in malpractices for selfish ends, shall be given administrative sanctions in accordance with the relevant provisions; If a crime is constituted, criminal responsibility shall be investigated according to law.
Thirty-seventh metallurgical enterprises in violation of the provisions of Article 21, Article 23, Article 24 and Article 27, given a warning, and impose a fine of 65438 yuan to 0000 yuan to 30000 yuan.
Thirty-eighth metallurgical enterprises have one of the following acts, shall be ordered to make corrections within a time limit; Overdue correction, a fine of 20 thousand yuan:
(a) failing to file the safety pre-evaluation report, safety articles and safety acceptance evaluation report in accordance with the provisions;
(two) gas production, transportation, use, maintenance, maintenance personnel without training qualified to work;
(3) Failing to recruit laborers from legal labor service companies, or failing to sign contracts with labor service companies, or failing to provide unified education and training for laborers in production safety.
Chapter V Supplementary Provisions
